Agricultural Law Weekly Review—September 4, 2023

WOTUS: EPA and Army Issue ‘Waters of the United States’ Pre-Publication Final Rule 🌾
On August 29, 2023, the U.S. Environmental Protection Agency (EPA), with the U.S. Department of the Army, announced that the agencies had released a pre-publication final rule and regulatory text changes to amend the definition of “Waters of the United States” (WOTUS) in accordance with Sackett v. EPA. According to an accompanying fact sheet released by the agencies, the final rule omits “interstate wetlands” from the “interstate waters” jurisdictional language and “wetlands and streams” from the “additional waters” jurisdictional language; removes the “significant nexus” standard from “tributaries,” “adjacent wetlands,” and “additional waters”; and revises the definition of “adjacent” to “having a continuous surface connection.” According to the pre-publication rule, the official final rule will be posted in the Federal Register and at regulations.gov docket EPA-HQOW-2023-0346 and will take effect immediately upon Federal Register publication. Additionally, the agencies will host a webinar on the new rule on September 12, 2023 at 3:00 p.m. ET and state that they will also “host listening sessions this fall” to “identify[] issues that may arise outside th[e] . . . rule to conform the definition of ‘waters of the United States’ with the Sackett v. Pesticides/Herbicides: EPA Restricts Malathion Use Nationwide
On August 23, 2023, the U.S. Environmental Protection Agency (EPA) announced the implementation of nationwide restrictions for the use of malathion, an insecticide used to control many types of insects including mosquitos. In April 2021, the U.S. Fish and Wildlife Service (USFWS) released a draft biological opinion (BiOp) identifying “78 listed species that could be jeopardized by how malathion was used before the consultation process,” which the agencies finalized in February 2022. EPA states the BiOp will be implemented through “mitigation measures including no spray zones, reductions in application rates and number of applications,” and “by issuing Endangered Species Protection Bulletins, available on the Bulletins Live! Two website, and approving malathion label amendments to incorporate measures to protect listed species.”

Pesticides/Herbicides: EPA Publishes Final Rule Establishing Pyraclonil Tolerances for Rice, Grain
On August 24, 2023, the Environmental Protection Agency (EPA) published the final rule establishing pesticide tolerances for pyraclonil. The final rule, requested by Nichino America, Inc., allows for pyraclonil “residues . . . in or on rice, grain at 0.01 ppm” and “directly regulates growers, food processors, food handlers, and food retailers.” The final rule became effective upon publication and states that all objections and requests for hearings must be received and filed according to 40 CFR part 178 by October 23, 2023.

Right to Farm: Federal Court Dismisses Hog Waste Trespass and Nuisance Claims
On August 16, 2023, the U.S. District Court for the Eastern District of North Carolina published an opinion granting Murphy-Brown Holdings, LLC and Smithfield Foods Inc.’s motion for summary judgment, dismissing trespass and nuisance claims alleged by eighteen neighbor plaintiffs. Barden et al v. Murphy-Brown Holdings, LLC, et al, No. 7:20-cv-00085. In their May 2020 complaint, the plaintiffs alleged that Duplin County-based Vestal Farms, a Smithfield Foods Inc. subsidiary that operated as a Large Concentrated Animal Feeding Operation (CAFO), negligently allowed animal waste to “drift in the wind and trespass on Plaintiffs’ properties.” The plaintiffs also alleged that “the presence of urine and feces on Plaintiffs’ property, has caused periodic swarms of flies, insects, and other pests.” The judge held that the plaintiffs “failed to produce evidence sufficient to create a genuine issue of material fact that the defendants were the proximate cause of plaintiffs’ injury,” on both the trespass and nuisance claims and dismissed the suit with prejudice. Disaster Assistance Programs: USDA Updates Livestock Disaster Payment Rate for Cattle Lost Due to Heat
On August 25, 2023, U.S. Department of Agriculture (USDA)’s Farm Service Agency (FSA) announced an update to the Livestock Indemnity Program (LIP) payment rate for Midwest livestock producers “who have lost cattle to the heat and humidity experienced this summer.” According to the announcement, “the 2023 LIP payment rate for beef calves over 800 pounds will increase from $1244 per head to $1618.” Additionally, “the updated LIP payment rate is effective immediately and will be applied retroactively starting Jan. 1, 2023.”

Environmental Credit Trading: USDA’s Forest Service Announces $150 Million for Climate Market Participation for Small Acreage & Underserved Forest Landowners
On August 22, 2023, U.S. Department of Agriculture’s Forest Service announced $150 million in funding for the Inflation Reduction Act Forest Landowner Support program for forest landowners who own 2,500 acres or less or qualify as “underserved” to participate in “emerging voluntary private-sector [climate] markets.” The announced funding was provided through the 2021 Infrastructure Investment and Jobs Act. (P.L. 117-58). According to the notice of funding opportunity, the program consists of three tracks:

  • Track A—for proposals “greater than or equal to $2 million and less than $25 million”;
  • Track B—for proposals “less than $2 million”; and
  • Track C—for “proposals to administer a national competitive regranting program,” which “must be greater than or equal to $5 million, less than $50 million, and include at least 80 percent sub-awards.”

Track A proposals are due October 21, 2023 and Track B and C proposals will be reviewed quarterly. The application window closes August 21, 2024.

Animal Welfare: Congress Members Send Letter to House Agriculture Committee Leadership Opposing EATS Act
On August 21, 2023, 171 Congress members sent a letter to House Agriculture Committee Chairman Glen Thompson and ranking member David Scott expressing their “opposition to the inclusion of H.R. 4417, the Ending Agricultural Trade Suppression (EATS) Act, or any similar legislation in the 2023 Farm Bill.” According to the letter, “15 states [have] enact[ed] public health, food safety, and humane standards for the in-state production and sale of products from egg-laying chickens, veal calves, and mother pigs,” including California’s Proposition 12, which the Supreme Court recently upheld. The signed Congress members stated that passage of the EATS Act “would drastically broaden the scope of federal preemption and impede the ability of voters and elected officials to enact laws that address local concerns” and  “urge[d] [the committee] to reject inclusion of th[e] provision or anything like it in the Farm Bill.” For more on animal welfare issues, see the Center’s Animal Confinement Issue Tracker.

National Agricultural Policy: USDA Provides $73 Million for Specialty Crop Block Project Grants
On August 23, 2023, the U.S. Department of Agriculture (USDA) Agriculture Marketing Service (AMS) announced $72.9 million in Specialty Crop Block grants across all 50 states, four territories, and the District of Columbia, including $1 million for Pennsylvania. According to the announcement, the grant projects include “food safety, specialty crop research, including research to focus on conservation and environmental outcomes, developing new and improved seed varieties and specialty crops, and pest and disease control.” Pennsylvania A comprehensive list of these projects including budgets and descriptions is available here.

Agricultural Finance: USDA Announces $123 Million for Meat and Poultry Processing Expansion Program
On August 24, 2023, the U.S. Department of Agriculture (USDA) Rural Development (RD) announced the availability of $123 million in additional grant funding for the Meat and Poultry Processing Expansion Program. According to the announcement, the additional finding is provided through a partnership with the New Hampshire Community Loan Fund and may be used for numerous activities, including “build[ing] and moderniz[ing] processing facilities and equipment, adopt[ing] new technologies and train[ing] workers.” Grants range from $250,000 to $10 million and may be used to cover up to 30% of project costs. Applications are due November 22, 2023.

Water Quality: USDA Announces $808 Million for Rural Electric, Water and Infrastructure Projects
On August 28, 2023, the U.S. Department of Agriculture (USDA) announced $808 million—$694 million in loans and $114 million in grants—for 139 rural electric, water, and infrastructure projects in 36 states, Puerto Rico, and the Marshall Islands. According to the announcement, the funding will assist 480,000 people and provide $78 million for lead pipe replacement and repair. In Pennsylvania, the Sunbury Municipal Authority in Northumberland County received a $2,000 grant for a new sewer televising system and the Escape Property Owners Association in Pike County received a $3 million loan to build a new wastewater package plant.

Water Quality: EPA, Hershey Co. Announce $2 Million For Local Dairy Farmers
On August 22, 2023, The U.S. Environmental Protection Agency (EPA) announced that it will partner with The Hershey Company to commit “$2 million to support local dairy farmers.” EPA states that the funds, to be distributed by the National Fish and Wildlife Foundation, will be used by the “Alliance for the Chesapeake Bay, in collaboration with Land O’Lakes, Inc. . . . to promote the adoption of practices that support local and regional environmental goals with dairy farmers in Land O’Lakes’ eastern region milk shed.” Hershey, Land O’Lakes, and the Alliance state that they have formally worked together in partnership “to implement on-farm best management practices to reduce greenhouse gas emissions and help improve water quality in the Chesapeake Bay watershed,” since June 2021.

Agricultural Data: Vermont Releases Online Feed-Finder Marketplace
On August 25, 2023, the Vermont Agency of Agriculture, Food and Markets (VAAFM) and the Vermont Agency of Digital Services (ADS) announced a new, online resource for farmers and producers “looking to buy and/or sell feed.” The website allows “[t]hose selling hay, alfalfa, corn, soy, silage, and haylage” to “easily advertise their feed on the directory.” Sellers can “include details like whether the feed is organic and if [they] can deliver.” Individuals who are interested in finding feed for sale can search by “availability, location, and pricing.” Use of the system is free for both buyers and sellers.

Local Food: USDA Local Food Purchase Assistance Program Distributes $2.5 Million to Kansas in $467 Million Second Funding Round
On August 23, 2023, the Kansas Department of Agriculture (KDA) announced that the agency had received an additional $2.5 million from the U.S. Department of Agriculture (USDA) Agricultural Marketing Service’s (AMS) Local Food Purchase Assistance Program (LFPA) to “purchase and distribute Kansas grown and processed foods to underserved communities . . . [in] Kansas for an additional year.” In summer 2022, KDA received $2.5 million as part of the initial $400 million in LFPA funding, distributed to 48 states (Arizona and Wyoming did not participate), three territories, and numerous tribes. In March 2023, USDA announced $464 million in additional LFPA funding and extended the application deadline until May 12, 2023. According to KDA’s announcement, LFPA funds have been used to “purchase[] local food from over 20 Kansas producers and . . . distribute[] nearly 800,000 pounds of Kansas-grown produce throughout the state in the first growing season of the program.”  For more on food distribution program structures, see materials from An Overview of U.S. Charitable Food Surplus Programs, Audry Thompson presentation with the National Agricultural Law Center.
