Agricultural Law Weekly Review – Week Ending June 4, 2021

COVID-19:  Congressional letter calls for Emergency Temporary Standard and FY 2022 Budget Outlines Intent for Infectious Disease Rulemaking 🌾
On June 2, 2021, one-hundred and six members of the U.S. House of Representatives sent a letter to President Biden urging the issuance of an OSHA Emergency Temporary Standard (ETS) addressing worker protection from COVID-19 in the workplace.  The request cited the March 15, 2021 deadline for such a standard included in January 21, 2021’s Executive Order (E.O. 13999) and the Office of Management and Budget’s (OMB) delay in reviewing the draft ETS sent to the White House on April 26, 2021.  See ALWR—Week Ending April 30, 2021, “White House Reviewing OSHA’s Long-Delayed Emergency Temporary Standard.  Parallel to that, according to the U.S. Department of Labor (DOL) Occupational Safety and Health Administration’s (OSHA) recently published FY 2022 Congressional Budget Justification, included in DOL’s Fiscal Year (FY) 2022 Budget, OSHA is requesting a $10 million budget increase, including 30 additional full-time employees, for its Safety and Health Standards activity, which includes the agency’s plan to revive and move forward with an Infectious Disease Rulemaking, addressing the prevention of infectious disease transmission in workplaces previously commenced. OSHA initiated a request for information (75 FR 24835) in 2010 and conducted stakeholder meetings (76 FR 39041) in 2011 for a proposed rule on infectious diseases transmission in the workplace (RIN:1218-AC46), but the rulemaking process was placed under “long-term actions” in the agency’s 2017 regulatory agenda and never revived by the Executive Branch since the COVID-19 pandemic onset.   OSHA now intends to publish a draft proposed rulemaking and seek public comment in 2022.

Food Safety: Court Denies Challenge to Butter Pasteurization Regulation
On May 24, 2021, the U.S. District Court for the District of Columbia issued an opinion granting summary judgment in favor of the U.S. Food and Drug Administration (FDA) in a challenge to the agency’s authority to require the pasteurization of butter in interstate commerce under 21 CFR §1240.61, Mandatory pasteurization for all milk and milk products in final package form intended for direct human consumption.   McAfee v. U.S. Food and Drug Administration, No. 1:19-cv-03161.  The case was brought by the Farm-to-Consumer Legal Defense Fund and Mark McAfee, the owner of California-based Organic Pastures Dairy, which sells raw milk nationally labelled as pet food under its brand “Raw Farm.”  The Plaintiffs claimed that the FDA lacked statutory authority to mandate butter pasteurization and requested that the agency remove butter from the definition of milk products under 21 CFR §1240.3 but the Court found that the pasteurization rule was authorized by FDA’s broad authority under the Public Health Service Act (PHSA) to protect the public against the spread of communicable disease and in deference to the agency accepted FDA’s rationale that only pasteurization destroys disease-causing pathogens.

Crop Insurance: USDA Announces Premium Payments Under Pandemic Cover Crop Program
On June 2, 2021, the U.S. Department of Agriculture (USDA) Risk Management Agency (RMA) posted in the Federal Register a “Notice of Funding Availability” for the Pandemic Cover Crop Program (PCCP) (86 FR 29553), which will provide a premium payment of up to $5 per acre to producers who planted a qualifying cover crop during the 2021 planting season and insured their spring crop under an authorized insurance policy.  Also announced by RMA, the agency states that all FSA-reportable cover crops are eligible but PCCP is not available for Whole-Farm Revenue Protection, Enhanced Coverage Option, Hurricane Insurance Protection – Wind Index, Supplemental Coverage Option, and Stacked Income Protection because they are either incompatible with acreage reporting or already provide the benefit.  Producers must file a Report of Acreage form (FSA-578) by June 15, 2021, which the agency notes is separate from the normal acreage reporting date.

Pesticides/Herbicides: New Dicamba Property Damage Suits Filed Outside Scope of Prior Settlement
On May 25, 2021, Coy’s Honey Farm, Inc., filed a complaint in the United States District Court for the Eastern District of Arkansas, docketed at 3:21-cv-00104, against Bayer and BASF seeking damages for non-target dicamba-caused property damage, consequential economic damages to Coy’s bee-keeping and honey production operation of approximately 13,000 hives.  The suit alleges multiple tort and statutory commercial misrepresentation claims and seeks punitive damages.  In addition, on June 4, 2021, a group of fifty-seven Texas High Plains grape growers, alleging to possess 3000 acres planted in grapes and constituting 85% of Texas’ $13 billion state wine industry, filed suit in Texas state Court (Jefferson County) against Bayer and BASF seeking damages for non-target dicamba-caused property damage and consequential economic damages to their vineyard operations alleging products liability theories and seeking punitive damages. Recent settlement efforts by Bayer have only been addressed to non-dicamba tolerant soybean and cotton damage.
