Agricultural Law Weekly Review—September 18, 2023

Conservation Programs: Federal Court Vacates USDA Decision Not Listing Eastern Hellbender Under Endangered Species Act 🌾
On September 5, 2023, the U.S. District Court for the Southern District of New York issued an opinion vacating and remanding the U.S. Department of Agriculture (USDA) Fish and Wildlife Service’s (FWS) April 2019 proposed rule, which declared unnecessary the eastern hellbender’s Endangered Species Act (ESA) listing as endangered or threatened. Ctr. Biological Diversity v. U.S. Fish and Wildlife Service, No. 1:21-cv-05706. The court determined that FWS’s “consider[ation] of conservation efforts that have not yet been demonstrated to be effective”—specifically “habitat restoration, management, and preservation” through the use of “artificial nest boxes” and “captive propagation through the collection of fertilized eggs . . . raised in captivity until they reach two-to-four years of age”—“was arbitrary and capricious and not in accordance with law, and relied on improper factors.” The vacatur now requires FWS to restart the twelve-month process to re-evaluate whether the eastern hellbender should be listed under the ESA.

Industrial Hemp: Federal Court Issued Injunction Against Arkansas Law Prohibiting ‘Synthetic’ Hemp Products
On September 7, 2023, the U.S. District Court for the Eastern District of Arkansas issued an order granting preliminary injunction against Arkansas’s Act 629 (SB 358), which, among other actions, “criminalized all hemp products produced as a result of a synthetic chemical process,” but allowed for the “continuous transportation” of hemp through the state in accordance with the 2018 Farm Bill. Bio Gen LLC v. Arkansas, No. 4:23-cv-00718. The plaintiffs claimed that the law was vague and was preempted by the 2018 Farm Bill, which defined hemp as “the plant Cannabis sativa L. . . . and all derivatives . . . with a delta-9 [THC] concentration of not more than 0.3 percent on a dry weight basis.” The plaintiffs’ expert witness testified that “there is no way to determine whether the[] substance[s] [at issue] are derived from a hemp plant, or through a completely synthetic process because the substances are molecularly the same.” The court found that the plaintiffs demonstrated a likelihood of success on their claims, calling the expert’s testimony “persuasive” and noting that “‘[c]ontinuous transportation’ is not defined or explained in Act 629 or elsewhere. The court stated, “Arkansas may continue to enforce laws regarding the growing of hemp within its borders, but not its interstate transportation.”

Dairy Policy: USDA Establishes Milk Loss Program for 2020, 2021 and 2022 Disaster Events
On September 11, 2023, the U.S. Department of Agriculture (USDA) Farm Service Agency (FSA) published in the Federal Register a final rule (88 FR 62285), effective immediately, which establishes funding for the Milk Loss Program (MLP) for dairy producers impacted by “qualifying disaster events” in 2020, 2021, and 2022. Also announced by USDA, the MLP will provide assistance to “dairy operations for milk dumped or removed without compensation from the commercial milk market due to qualifying disaster events, including droughts, wildfires, hurricanes, floods, derechos, excessive heat, winter storms, freeze, and smoke exposure.” Producers can apply for MLP funding through their local FSA county office.

Transportation: Surface Transportation Board Publishes ‘Reciprocal Switching for Inadequate Service’ Notice of Proposed Rulemaking
On September 5, 2023, the Surface Transportation Board (STB) published a notice of proposed rulemaking (NPRM) titled “Reciprocal Switching for Inadequate Service,” also announced by the STB on September 7, 2023. The NPRM would allow shippers to use an alternative rail carrier on their regular carrier’s lines if their carrier “fails to meet any of three performance standards”: service reliability, service consistency, and inadequate local service. According to the announcement, the proposed rule would “for the first time . . . require all three service metrics be standardized across all Class I carriers” and would also “require all Class I carriers to provide their customers with the historical data for these service metrics within seven days of a customer’s request.” Additionally, “the reciprocal switching agreements would be for a minimum period of two years and up to a maximum of four years,” although STB states that it “seeks comment on whether a longer period is necessary to ensure the rule’s effectiveness.” Comments on the proposed rulemaking are due October 23, 2023 and replies to comments are due November 21, 2023.

International Trade: U.S. Trade Representative Announces Poultry Trade Resolution, Reduced Tariffs with India
On September 8, 2023, the Office of U.S. Trade Representative (USTR) Katherine Tai announced that the United States and India have agreed to settle their final World Trade Organization dispute, initiated in March 2012 by the United States after India prohibited the import of several animal and poultry products due to “purported[] . . .  concerns related to Avian Influenza” (DS 430). According to the announcement, in addition to allowing import of the originally disputed products, “India has also agreed to reduce tariffs on certain U.S. products, including frozen turkey, frozen duck [and] fresh . . . frozen . . . dried . . . and processed blueberries and cranberries.” According to a statement released by Agriculture Secretary Tom Vilsack in support of the agreement, although “important progress has been made, significant tariff and nontariff barriers to American agricultural products accessing the Indian market remain.”

Water Quality: Pennsylvania DEP Publishes Draft Technical Guidance on Land Application of Manure
On August 26, 2023, the Pennsylvania Department of Environmental Protection published in the Pennsylvania Bulletin a notice (53 Pa.B. 5344) publicizing the availability of draft technical guidance documents (TGD), including guidance titled “Land Application of Manure—A Supplement to Manure Management for Environmental Protection,” available at www.depgreenport.state.pa.us/elibrary/. The draft revisions to the TGD include a “Manure Management Plan Short Form” and updated worksheets to clarify information and procedures for agricultural operations, including animal management, environmental sensitivity, and manure calibration. Interested parties may submit written comments on the draft TGD until September 25, 2023.

Water Quality: Organizations File Ninth Circuit Appeal of EPA’s Clean Water Act CAFO Petition Denial
On September 8, 2023, a coalition of environmental organizations filed a petition for review in the U.S. Court of Appeals for the Ninth Circuit Court against the U.S. Environmental Protection Agency (EPA) seeking to compel the agency to regulate Concentrated Animal Feeding Operations (CAFOs) under the Clean Water Act following the agency’s denial of the organizations’ petition in August 2023. Food Labeling: Tofurky Seeks Injunction Against Texas Meat Labeling Law
On August 31, 2023, Turtle Island Foods (doing business as “The Tofurky Co.”) filed a complaint in the U.S. District Court for the Western District of Texas alleging that a new Texas law (S.B. 664)—which prohibits using meat terms on plant- or cell-based products unless the label also contains specific non-meat terms—violates the “First Amendment, the Supremacy Clause, the Due Process Clause . . . and the Dormant Commerce Clause of the U.S. Constitution.” Turtle Island Foods SPC v. Abbott, No. 1:23-cv-01032. In its complaint, Tofurky argues that S.B. 664 violates the First Amendment because “the restrictions and requirements . . . go beyond what would be necessary to protect any purported state interest in preventing consumer deception.” Tofurky seeks declaratory and injunctive relief against the law, which became effective September 1, 2023. Biotechnology: Consumer Groups Seek Vacatur of 2018 Bioengineered Food Disclosure Final Rule, File Opening Appellate Brief
On September 5, 2023, several consumer advocacy groups filed their opening brief in the U.S. Court of Appeals for the Ninth Circuit seeking reversal of the district court’s 2022 order and vacatur of the U.S. Department of Agriculture (USDA) Agricultural Marketing Service’s (AMS) Bioengineered Food Disclosure Standard final rule, issued in 2018. Natural Grocers v. Thomas Vilsack, No. 22-16770. The appellant groups argue, among other issues, that the lower court “failed to exhaust statutory interpretation tools before deferring . . . to USDA’s post hoc rationalization to support its highly refined foods exemption” and dispute USDA’s use of the term “bioengineered”—instead of GE or GMO—as “the only proper term.” Additionally, the groups claim that the lower court should have vacated the 2018 rule after finding the agency’s QR code disclosure option in violation of the Administrative Procedure Act. According to the court’s briefing schedule, USDA must submit its brief by November 17, 2023. Water Quality: Conservation Groups File Suit Against Utah Seeking Review of Water Diversions, Water Level Restoration in Great Salt Lake
On September 6, 2023, five conservation and community groups filed a complaint in the Third Judicial District Court, Salt Lake County, Utah, alleging breach of trust duty against the state of Utah for the state’s “failure to protect the Great Salt Lake” and to “ensure sufficient water reaches” the Lake. Utah Physicians for a Healthy Env’t v. Utah Dep’t of Natural Res., No. 230906637. The complaint describes the extreme water loss of the Great Salt Lake, stating that, since 2016, “the Lake ha[s] lost approximately 73 percent of its water and 60 percent of its surface area as of the fall of 2022,” and notes a January 2023 briefing report from Brigham Young University that stated, “[o]ver the last three years, the lake has received less than a third of its natural streamflow because of excessive water diversions.” The complaint alleges that Utah “failed to review and modify upstream diversions,” which have caused an “unsustainable quantity of water [to be] diverted away from the Lake.” The plaintiffs’ argument relies on the public trust doctrine, under which “the public owns many natural resources, and the State holds and manages them in trust for the public.” The plaintiffs request declaratory and injunctive relief pursuant to Utah statute and the state court’s authority.

Conservation Programs: Alaska, Energy Companies File Complaints Over Tongass National Forest Logging Ban Reinstatement
On September 8, 2023, the state of Alaska and two power companies filed separate complaints against the U.S. Department of Agriculture (USDA) in the U.S. District Court for the District of Alaska, alleging that the Biden administration unilaterally reinstated a ban on logging and road construction in the Tongass National Forest, bypassing the requirement for congressional approval. Alaska v. USDA, No. 3:23-cv-00203 and Inside Passage Electric Cooperative v. USDA, No. 3:23-cv-00204. The state of Alaska seeks a court order nullifying the reinstatement of the 2001 Roadless Area Conservation Rule and the power companies assert that the 2001 Rule is obstructing their pursuit of green energy initiatives aimed at reducing utility expenses for regional residents.

Conservation Programs: USDA Announces $65 Million for Conservation Innovation Grants, Prioritizes Ruminant Emissions Reduction
On August 31, 2023, the U.S. Department of Agriculture’s (USDA) Natural Resources Conservation Service (NRCS) announced the availability of up to $65 million for Conservation Innovation Grants (CIG). The grant funds are available through two programs: the CIG Classic ($15 million) and the CIG On-Farm Trials ($50 million). Both competitive grant programs seek applicants to propose new projects to address issues concerning “water quality, water quantity, air quality, soil health, and wildlife habitat challenges.” According to the announcement, NRCS will “prioritize CIG On-Farm Trials projects that use diet and feed management to reduce enteric methane emissions from ruminants, as well as other projects that have climate mitigation benefits.” Applications are open until October 30, 2023.

National Agriculture Policy: USDA Announces $266 Million in Rural Energy Project Awards
On August 30, 2023, the U.S. Department of Agriculture (USDA) announced $266 Million in awarded grants and loans through the Rural Energy for America Program (REAP), funded primarily by the Inflation Reduction Act. According to the announcement, the funding will support “1,334 renewable energy and energy-efficiency projects in 47 states, Guam and Puerto Rico,” including more than 100 projects in Pennsylvania. USDA is currently accepting applications for REAP and states that awards will be distributed quarterly through September 2024.

Farm Bill: The National Governors Association Publishes Letter Outlining Farm Bill Priorities
On September 5, 2023, the National Governors Association (NGA) Education, Workforce, and Community Investment Task Force published a letter to House and Senate Agricultural Committee leaders, outlining their priorities for the upcoming Farm Bill reauthorization. The governors state that they “urge continued support for the Price Loss Coverage and Agriculture Risk Coverage programs and urge consideration of adjusting reference pricing to reflect recent changes in crop prices.” Additionally, the governors wrote that they “support the Dairy Margin Coverage Program and recommend increasing Tier 1 coverage as well as increasing the margin pricing index” and “urge[d] Congress to avoid preempting state level laws regarding agriculture production.”

Dairy Policy: Penn State Study Finds Increased Dairy Pricing Linked to Industry Expansion, Water Quality
In May 2023, Penn State College of Agricultural Sciences Professors Zeya Zhang and David Abler published a study titled “Dairy Pricing Policy, Production, and Water Quality: Application to the Chesapeake Bay Watershed.” Also announced by the university, the study modeled the “impacts on the sizes of six livestock sectors (dairy cows, beef cattle, hogs, broilers, layers, and turkeys), production level, net income, and water quality outcomes” from raising the Class I price mover to $15.68 for June–August 2020, as requested by the Dairy Marketing Association in April 2020 and in consideration of increased livestock feed costs. The study found that the increased milk price, despite increased costs, led to overall increased revenues and industry expansion, “lead[ing] to an increase in nitrogen emissions but a decrease in phosphorus emissions for the livestock industry as a whole,” which “also holds for nutrient deliveries to the Chesapeake Bay.” For more on dairy, see the Center’s Pennsylvania Milk Marketing Board Legal Developments Issue Tracker and Dairy and Dairy Products Law Virtual Resource Room.

Water Quality: President’s National Infrastructure Advisory Council Publishes Report on Preparing for Evolving Water Crises
In August 2023, the President’s National Infrastructure Advisory Council published a pre-decisional report titled, “Preparing United States Critical Infrastructure for Today’s Evolving Water Crises.” The report describes the possibility of a “Day Zero”—“the day when taps in a city would run dry”—in the United States. Although the report states that “power generation is the biggest user of our nation’s water at 41%,” it lists “irrigation, at 37%, [a]s the next largest user” and notes that “agriculture is the biggest consumer of water both nationally and globally.” According to the report, 60% of public water is supplied through surface water “with the remaining 40% coming from groundwater aquifers.” The report calls for the creation of a national water strategy and recommends several government actions to help water infrastructure owners and operators and mitigate the impact of potential water scarcity. Additionally, on August 28, 2023, the New York Times published an analysis of water use in the United States titled “America Is Using Up Its Groundwater Like There’s No Tomorrow,” which concluded that “[o]veruse is draining and damaging aquifers nationwide.”
