Avian Influenza: USDA Announces 28 States Enrolled in National Milk Testing Strategy, HHS Announces $306 Million for Avian Flu 🌾
On January 8, 2025, the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) announced that 15 additional states have enrolled in the National Milk Testing Strategy: Alabama, Arizona, Delaware, Iowa, Georgia, Kansas, Minnesota, New Jersey, New Mexico, Nevada, Oklahoma, Rhode Island, Tennessee, Utah, and Virginia. According to the announcement, 28 total states—representing “nearly 65% of the nation’s milk production”—are now enrolled in the program, including California, Colorado, Michigan, Mississippi, Oregon, and Pennsylvania, which enrolled on December 6, 2024; and Indiana, Maryland, Montana, New York, Ohio, Vermont, and Washington, which enrolled on December, 17, 2024. USDA also reported that the agency “has identified H5N1 detections in dairy herds in . . . California and Texas” within the past 30 days. Previously, on December 18, 2024, California Governor Gavin Newsom issued a proclamation declaring a state of emergency due to avian influenza (H5N1). Additionally, on January 3, 2025, the U.S. Department of Health and Human Services (HHS) announced $306 million for avian flu monitoring, preparation, and research. Invasive Species: USDA Announces Import Restrictions on Live Animals from Belize
On January 7, 2025, the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) published an import alert (PDF) advising that “effective January 3, 2025, and until further notice,” the agency “is restricting the importation of animal commodities originating from or transiting Belize based on the confirmation of New World screwworm in cattle.” The agency states that it already “prohibits the importation of live ruminants, swine, and their germplasm from Belize due to diseases other than New World screwworm.” According to the notice, APHIS will permit certain exceptions for dogs and horses.
Organic Agriculture: USDA Publishes Final Rule Amending Organic Regulations for Pet Food and Mushrooms
On December 23, 2024, the U.S. Department of Agriculture (USDA) Agricultural Marketing Service (AMS) published in the Federal Register a final rule (89 FR 104367) “amending the USDA organic regulations to clarify standards for organic mushrooms and organic pet food” (AMS-NOP-22-0063). Also announced (PDF) by AMS, the rule “appl[ies] the regulations for organic processed products to pet food” and “allow[s] the synthetic amino acid taurine to be used in organic pet food.” The rule additionally amends regulations for organic mushroom production by adding or modifying the terms “compost,” “crop,” “wild crop,” “mushroom,” mushroom mycelium,” “mushroom spawn,” “mushroom spawn media,” and “mushroom substrate”; and specifying production practices for organic mushrooms, including exempting mushroom producers from certain practice standards for soil fertility, crop nutrient management, seeds, planting stock, and crop rotation. However, the “final rule clarifies that mushroom producers are subject to the same nutrient management prohibitions as plant producers . . . in § 205.203(e) and may optionally follow the nutrient management practices in § 205.203(d).” The final rule becomes effective February 21, 2025, and producers must comply with the rule by February 22, 2027.
Animal Health: USDA’s Publishes Proposed Rule to Codify US Swine Health Improvement Plan
On December 31, 2024, the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) published in the Federal Register a proposed rule (89 FR 107045) to codify as a “Federal regulatory program” the US Swine Health Improvement Plan, “a voluntary livestock improvement program aimed at improving biosecurity, traceability, and disease surveillance for swine health” comparable to the National Poultry Improvement Plan. Also announced by APHIS, the proposed rule would “allow participating sites to obtain certifications of disease-monitored status for African [and classical] swine fever” and “market their products with the relevant certification status,” which APHIS states “could limit disruptions to international and interstate commerce during outbreaks.” The proposed rule is available for public comment until January 30, 2025 (APHIS-2022-0061). Biotechnology: FDA Publishes Guidance on Approval Process for ‘Intentional Genomic Alterations in Animals’
On January 7, 2025, the U.S. Food and Drug Administration (FDA) published in the Federal Register a notice (90 FR 1156) making available final guidance on the “Heritable Intentional Genomic Alterations (IGA) in Animals: The Approval Process” (FDA-2019-D-2648). FDA states that the guidance (GFI #187B) “is applicable once a sponsor is submitting an application for approval for IGAs described as Category 3” in a separate guidance document issued in May 2024 (GFI #187A), which describes the agency’s “risk-based approach to IGAs in animals.” According to the guidance, “products that may be appropriate for Category 3 are those that are intended for human or animal health-related uses, are intended for release into the environment, or that may be less familiar . . . [or] more complex.” Additionally, FDA “note[s] that what we are regulating (i.e., the regulated article) is the IGA in the animal, not the animal itself.” See also ALWR—May 10, 2024, “FDA Publishes Guidance for ‘Intentional Genomic Alterations in Animals,’ Signs MOU with USDA.”
Food Labeling: FDA Publishes Q&A Guidance on Food Allergen Labeling
On January 7, 2025, the U.S. Food and Drug Administration (FDA) published in the Federal Register a notice (90 FR 1133) making available revised final guidance on “Questions and Answers Regarding Food Allergen Labeling” (FDA-2022-D-0099). According to the guidance document, “foods regulated under the [Food Drug and Cosmetic (FD&C) Act] are misbranded unless they declare the presence of each major food allergen on the product label using the name of the food source from which the major food allergen is derived.” The FD&C Act defines a “major food allergen” as a food, food group, or “ingredient that contains protein derived from one of the following: Milk, Eggs, Peanuts, Wheat, Soybeans, Sesame, Fish, Crustacean shellfish, or Tree nuts.” FDA states that it “expects to continue to issue subsequent editions of th[e] guidance document by revising existing questions and answers and by adding new questions and answers.”
Food Labeling: FDA Publishes Draft Guidance on Plant-Based Alternatives Labeling
On January 6, 2025, the U.S. Food and Drug Administration (FDA) published in the Federal Register a notice (90 FR 1139) making available draft guidance on “Labeling of Plant-Based Alternatives to Animal-Derived Foods.” According to FDA, “the scope of th[e] guidance includes plant-based alternatives to eggs, seafood, poultry, meat, and dairy products . . . excluding . . . milk alternatives,” which FDA states “is being addressed elsewhere.” According to the guidance, “Because definitions and standards of identity have not been established for plant-based alternatives, these foods . . . must be labeled with their common or usual names, or . . . a statement of identity that accurately describes the food.” FDA specifies that “statements of identity are not necessarily precluded from using the names of animal-derived foods, including animal-derived foods for which FDA has established definitions and standards of identity,” but “the use of the names of animal-derived foods in the common or usual name or statement of identity must not cause the labeling to be misleading.” FDA states that the agency’s “assessment of whether the naming and labeling of these products complies with all relevant provisions of the Federal Food, Drug, and Cosmetic Act . . . will continue to be made on a case-by-case basis, considering the totality of the information.” The draft guidance is available for public comment until May 7, 2025 (FDA-2022-D-1102).
Food Safety: FDA Publishes Draft Guidance for Low-Moisture Ready-To-Eat Human Food Sanitation Programs
On January 7, 2025, the U.S. Food and Drug Administration (FDA) published in the Federal Register a proposed rule (90 FR 1052) making available draft guidance on “Establishing Sanitation Programs for Low-Moisture Ready-to-Eat (LMRTE) Human Foods and Taking Corrective Actions Following a Pathogen Contamination Event” to help producers of such foods comply with 21 CFR Part 117. According to FDA, applicable LMRTE foods include “powdered infant formula, peanut butter, nut butters, powdered drink mixes, chocolate, medical foods in powdered and paste forms, processed tree nuts, milk powders, powdered spices, snack foods such as chips and crackers, granola bars, and dry cereal.” The draft guidance is available for public comment until May 7, 2025 (FDA-2024-D-2604).
Local Agricultural Policy: California Board of Food and Agriculture Recommends Definition of ‘Regenerative Agriculture’
On January 10, 2025, the California State Board of Food and Agriculture published a letter to the state’s Department of Food and Agriculture (CDFA) Secretary Karen Ross recommending a definition of “regenerative agriculture” for state policies and programs. According to the board’s recommendation, “[r]egenerative agriculture . . . is an integrated approach to farming and ranching rooted in principles of soil health, biodiversity and ecosystem resiliency leading to improved targeted outcomes.” The definition additionally explains that “[r]egenerative agriculture is not an endpoint, but a continuous implementation of practices that over time minimize inputs and environmental impacts and further enhances the ecosystem while maintaining or improving productivity, economic contributions and community benefits.” The letter specifies that the recommended definition “is not a definition for certification or a recommendation for incorporation into state statute.”
Food Policy: California Governor Issues Executive Order to Investigate ‘Ultra-Processed Foods’ and Food Dyes
On January 3, 2025, California Governor Gavin Newsom issued Executive Order N-1-25 directing various state agencies to report and advise the governor’s office on the harms of “ultra-processed foods” and food dyes by April 1, 2025. Also announced by the governor’s office, the executive order also directs different state agencies to report and provide recommendations on
- “the feasibility of state–level evaluation of [Generally Recognized as Safe (GRAS)] food additives . . . and state-level action if companies fail to notify the [U.S. Food and Drug Administration (FDA)] of certain food additives through the voluntary GRAS process”;
- “[state-level] actions . . . to reduce the purchase of soda, candy, other ultra-processed foods and/or synthetic food dye or other additives”; and
- “areas where California may adopt higher standards for healthy school meals than [federal] standards . . . beyond those areas where California already has stricter standards,” among other actions.
Agribusiness: Smithfield Files Documents for Proposed Initial Public Offering, Signs Supply Agreement with VisionAg
On January 6, 2025, Smithfield Foods, Inc. filed with the U.S. Securities and Exchange Commission (SEC) a Form S-1 registration statement (PDF) “to sell shares of its common stock in an underwritten initial public offering” (CIK No. 91388), also available on the company’s “Investor Relations” website page. Also announced by Smithfield (PDF), the company states that its “existing shareholder . . . is also expected to sell shares of the Company’s common stock in the proposed offering,” although “[t]he timing, the number of shares that may be offered and the price range for the proposed offering have not yet been determined.” According to the announcement, Smithfield “has applied to list its shares of common stock on the Nasdaq Global Select Market under the ticker symbol ‘SFD.’” Smithfield states, however, that “[t]he offering is subject to market conditions, and there can be no assurance as to whether or when [it] may be completed, or as to the actual size or terms of the offering.” Previously, on December 20, 2024, the company announced (PDF) that it had “signed an agreement with VisionAg, LLC, an affiliate of HD3 Farms . . . to supply hogs to the company as an independent pork producer.”
Antitrust: Preliminary Approval Motion Filed for $180 Million Settlement with Chicken Processers in Wage-Fixing Class Action
On December 23, 2024, the class-action employee plaintiffs filed, in the U.S. District Court for the District of Maryland, a motion and supporting memorandum for preliminary approval of a $180 million settlement in a suit against several chicken processing companies alleging that the companies’ senior executives conspired to fix and lower the employee plaintiffs’ wages. Jien v. Perdue Farms Inc., No. 1:19-cv-02521. According to the memorandum, the settlements total as follows: “Allen Harim Foods, LLC ($5 million), Amick Farms, LLC ($6.25 million), Butterball, LLC ($8.5 million), Fieldale Farms Corporation ($5.5 million), Foster Poultry Farms ($13.3 million), Jennie-O Turkey Store, Inc. (JOTS) ($3.5 million), Koch Foods, Inc. ($18.5 million), O.K. Foods, Inc.
