GHG Emissions: The U.S. Supreme Court Grants Petitions for Writs of Certiorari Asking Review of EPA’s Authority over Regulation of GHG Emissions from Power Plants
On October 29, 2021, the U.S. Supreme Court agreed to hear multiple petitions for review of the U.S. Environmental Protection Agency’s (EPA) authority to regulate greenhouse gas emissions from power plants under the Clean Air Act (CAA). The petitions have been consolidated under docket No. 20-1530. The state of North Dakota (No. 20-1780) along with nineteen (19) other states (No. 20-1530), the North American Coal Corporation (No. 20-1531) and Westmoreland Mining Holdings, LLC (No. 20-1778) all filed separate petitions for writs of certiorari earlier in 2021 following the issuance by the D.C. Circuit Court of Appeals of an opinion vacating the 2019 Affordable Clean Energy Rule (84 FR 32520), which repealed the Clean Power Plant Rule (80 FR 64622). American Lung Association, et al. v. EPA, et al., No. 19-1140. Here, the D.C. Circuit Court found that EPA did not have the legal authority to adopt the Affordable Clean Energy Rule, stating that “the central operative terms of the ACE Rule and the repeal of its predecessor Rule, the Clean Power Plan, … hinged on a fundamental misconstruction of Section 7411(d) of the Clean Air Act.”

Biofuels: The U.S. Department of Energy (DOE) Announces Grant Opportunity for Increasing the Deployment of Biofuel and Bioproduct Refineries
On October 29, 2021, the U.S. Department of Energy (DOE) Office of Energy Efficiency and Renewable Energy (EERE) published a notice for a funding opportunity aimed at speeding up the deployment of biofuel and bioproduct refineries (DE-FOA-0002637). According to the notice, the Funding Opportunity Announcement (FOA) would fund Research & Development (R&D) activities in support of the “government-wide approach to the climate crisis by driving innovations that lead to the deployment of clean energy technologies. Specifically, this FOA will support high-impact R&D focusing on the production of low-GHG fuels for the aviation industry, the long-haul trucking sector, and marine industries by soliciting proposals to scale-up promising technologies.”

Federal Lands: The U.S. Bureau of Land Management (BLM) Will Analyze Greenhouse Gas Emission Impacts from 2022 Proposed Oil and Gas Lease Sales
On October 29, 2021, the U.S. Department of the Interior (DOI) Bureau of Land Management (BLM) indicated in a press release that it will conduct for the very first-time nationwide analysis of the impacts of greenhouse gas emissions from oil and gas production operations on public lands for the proposed 2022 oil and gas lease sales. The press release states that this nationwide analysis will be delivered as part of draft environmental assessments to be issued in the coming days. In addition, BLM also announced the release of the “2020 BLM Specialist Report on Annual Greenhouse Gas Emissions and Climate Trends.”

Air Quality: The U.S. Environmental Protection Agency (EPA) Faces New Lawsuit Over the 2008 Ozone National Ambient Air Quality Standards (NAAQS)
On October 27, 2021, the Center for Biological Diversity issued a notice of intent to sue the U.S. Environmental Protection Agency (EPA), citing “EPA’s Unreasonable Delay in Responding to the Remand of Final Action Entitled “Air Plan Approval; Pennsylvania; Reasonably Available Control Technology (RACT) for Volatile Organic Compounds (VOC) Under the 2008 Ozone National Ambient Air Quality Standards (NAAQS)”” (85 FR 80616) issued in December 2020. In their accompanying press release, plaintiff alleged that Pennsylvania’s Clean Air Act State Implementation Plan (SIP) is “inadequate … to clean up smog from the methane gas industry” and that, thirteen (13) years later, EPA has yet to reconsider the standard for ozone pollution. According to the plaintiff, EPA’s “unreasonable delay” represents a threat to human health and welfare, and the environment considering the urgent need to curb air pollution.
