Methane Emissions: White House Holds Methane Summit ⚡
On Wednesday, July 26, 2023, the White House released a fact sheet describing the White House Methane Summit, which was held that day.  The Summit focused on strategies to reduce methane emissions and with a focus on methane leaks from the oil and gas industry. The fact sheet also announced the creation of a Cabinet-level White House Methane Task Force, which will aid in the implementation of the U.S. Methane Emissions Reduction Action Plan.  The Summit examined the following topics: “Detecting Emissions Using Innovative Technology,” “Taking Common-Sense Actions to Mitigate Methane Emissions,” “Responding to Emissions Events,” and “Leading International Efforts on Methane Management.”

GHG Emissions: Colorado Passes Greenhouse Gas Intensity Verification Rule
On Thursday, July 20, 2023, the Colorado Department of Public Health & Environment posted a press release announcing the Colorado Air Quality Commission’s unanimous approval of a new greenhouse gas intensity verification rule. The rule, the first of its kind passed by any state, regulates how certain oil and gas facilities must calculate the ratio of greenhouse gas emissions to total oil and gas produced.  The rule applies to upstream oil and gas operations known as “well sites” or oil/gas “production” facilities.  The rule will take effect in 2025.

Pipelines: Supreme Court Overrules Fourth Circuit’s Stay on Mountain Valley Pipeline Construction
On Thursday, July 27, 2023, the United States Supreme Court granted Mountain Valley Pipeline, LLC’s Application to Vacate Stays in the ongoing Mountain Valley Pipeline case. Mountain Valley Pipeline, LLC v. The Wilderness Society, et al. no. 23-1384, 23-1592, 23-1594. The Fourth Circuit’s July 10 order halting construction on the Pipeline was therefore overruled, and construction may resume.

National Energy Policy: White House Announces Proposed Environmental Review Rule
On Monday, July 31, 2023, the White House Council on Environmental Quality (CEQ) released a proposed rule that is intended to simplify environmental reviews under the National Environmental Policy Act (NEPA).  The rule would allow more than one agency to develop joint categorical exclusions (actions not subject to environmental review).  The rule also eliminates the 2020 rule’s four-part public comment process, which CEQ has categorized as “an inappropriately stringent exhaustion requirement for public commenters and agencies.”  The proposed rule is open for public comment until September 29, 2023.
