On December 21, 2010, the U.S. Congress passed the FDA Food Safety Modernization Act (FSMA), which was subsequently signed into law by President Obama on January 4, 2011. FSMA substantially changed the authority granted to FDA under the Federal Food, Drug, and Cosmetic Act of 1938. FSMA requires FDA to create final rules addressing food safety topics including produce safety, hazard analysis, preventive controls, sanitary transportation of food, and foreign imports. These final rules shift the focus of food safety regulations from contamination response to contamination prevention.
