On Friday, March 28, 2025, from 12 noon–1:00 ET, the Penn State Center for Agricultural and Shale Law, alongside the Pennsylvania Department of Agriculture’s (PDA) Agricultural Business Development Center (ABDC), will present the next webinar program in the Understanding Agricultural Law Educational Series, a course designed to develop subject matter literacy and competence on fundamental issues of agricultural law for attorneys and business advisors who work with or represent agricultural or rural clients but may not necessarily specialize in agricultural law:
“Understanding the Basics of the Clean Water Act & Ag: Impaired Waters & TMDL Process”
Section 303(d) of the Clean Water Act (33 U.S.C. § 1313(d)) provides the legal authority for the U.S. Environmental Protection Agency (EPA) to require states to identify “impaired waters” within their jurisdictions and allows EPA to establish a Total Maximum Daily Load (TMDL), or “pollution diet” for those waters. As a party to the Chesapeake Bay, which spans six state jurisdictions and the District of Columbia, Pennsylvania is part of single largest TMDL in U.S. history.
This webinar will describe the CWA’s legal authority, its implementation and interpretation, issues and scenarios that may impact future TMDL processes, and potential legal implications for producers and landowners.
