Agricultural Law Weekly Review – Week Ending May 14, 2021

Pesticides/Herbicides: Ninth Circuit Denies Bayer’s Appeal of Federal Jury’s Glyphosate Verdict 🌾
On May 14, 2021, the U.S. Court of Appeals for the Ninth Circuit issued a decision denying all grounds for appeal by Bayer (successor to Monsanto’s Roundup product liabilities) from a March 2019 $25.3 million adverse jury verdict in the U.S. District Court for the Northern District of California finding that Plaintiff Edwin Hardeman’s exposure to Monsanto’s glyphosate-containing Roundup products caused his non-Hodgkin’s lymphoma.  Hardeman v. Monsanto, No. 19-16636, Ninth Circuit.  While Bayer alleged multiple grounds for appeal, its primary legal arguments are that state products liability law on failure to warn of a product’s risk of harm is preempted by the Federal Insecticide, Fungicide, and Rodenticide Act’s (FIFRA) label approval process and the U.S. Environmental Protection Agency’s (EPA) specific actions regarding cancer warnings on glyphosate-containing products.  The Ninth Circuit rejected this argument.  Prior to this decision, on March 19, 2021, Bayer made a public statement that the federal preemption defenses made in this case, upon which rest the extent of Bayer’s exposure to liability in the substantial majority of thousands of pending glyphosate claims, are “the most significant federal questions at issue in the Roundup litigation” and Bayer’s litigation strategy is to posture the preemption issues to be decided by the U.S. Supreme Court, through an appeal of any adverse outcome of the Hardeman case if necessary.

Biotechnology: Ninth Circuit Denies Appeal of Genetically Engineered Soy Leghemoglobin Approval for Impossible Foods
On May 3, 2021, the U.S. Court of Appeals for the Ninth Circuit issued a memorandum opinion denying the Center for Food Safety’s (CFS) petition for review requesting vacatur of the Food and Drug Administration’s (FDA) August 1, 2019 approval of genetically engineered soy leghemoglobin as an color additive for use in Impossible Foods’ plant-based imitation beef products.  Center for Food Safety v. FDA, et al, No. 20-70747.  Despite CFS’ claims to the contrary, the Court found that FDA had performed an  appropriate analysis and applied the correct standard in assessing soy leghemoglobin’s safety as a color additive.  The court further stated that FDA provided adequate justification for the studies it used and held that FDA’s expertise and experience in reviewing studies is entitled to deference.  According to Impossible Foods, soy leghemoglobin stands for legume hemoglobin and is a protein that contains heme, the molecule that carries iron in plants and animals, is responsible for the color, texture and taste of meat.

Biotechnology: AquaBounty Sells First Harvest of Genetically Engineered Salmon
On May 10, 2021, genetically engineered (GE) salmon producer AquaBounty announced that it had received purchase orders for all five metric tons of its first harvest of GE Atlantic salmon, due at the end of May, from the company’s Albany, Indiana facility.  According to the announcement, AquaBounty will increase its production to full capacity through the end of the year.  AquaBounty is currently the only company producing U.S. Food and Drug Administration (FDA)-approved GE Atlantic salmon.  For the history of FDA approval and related litigation regarding AquaBounty’s GE salmon, see the Center’s website’s Agricultural Law Issue Tracker titled Genetically Modified Salmon.

Dairy Pricing: Pennsylvania’s Dairy Producer Termination Notice Requirement Increased to Ninety Days
On May 12, 2021, the Pennsylvania Milk Marketing Board (PMMB) submitted to the Independent Regulatory Review Commission (IRRC) for approval final form regulation 47-18 titled “Transactions between dealers and producers; Termination of dealer-producer contract.”  It amends 7 Pa. Code § 143.31 to increase from twenty-eight to ninety the number of days’ notice required to be provided to a dairy producer by a milk dealer when terminating an agreement or course of dealing to purchase that producers’ raw milk.  The final form regulation provides for exceptions for financial distress, insolvency, insufficient customer sales and catastrophic events, all of which are defined very specifically in the regulation.  Dealers may negotiate an agreement containing a lower (or higher) number of days’ notice.  IRRC will consider the final form regulation for approval at its June 17, 2021 meeting.  For historical background, see Weekly Featured Graphic below.

Dairy Pricing: Milk Donations or Discounted Sales Do Not Violate Pennsylvania Mandatory Minimum Wholesale Prices
On May 12, 2021, the Pennsylvania Milk Marketing Board (PMMB) issued Bulletin No. 1594, titled Policy Regarding Charitable Donations And Charitable Sales Of Price-Controlled Packaged Products, which permanently expresses the PMMB policy that donations or discounted charitable sales of milk below Pennsylvania’s mandatory minimum prices are permissible if made to 501(c)(3) corporations and for bona fide charitable purposes.  This does not apply to sales to the USDA pursuant to its various food purchasing programs, including for The Emergency Food Assistance Program (TEFAP).  The new $400 million USDA Dairy Donation Program is not specifically addressed.  PMMB reporting and recordkeeping parameters are also specified.  Bulletin 1594 becomes effective upon the expiration of Pennsylvania Governor Wolf’s COVID-19 Proclamation of Disaster Emergency and will then replace April 10, 2020’s Bulletin No. 1573 which temporarily accomplished the same outcome.

Conservation Programs: PA Forestry Association Reports 7,000 Acres Enrolled in Family Forest Carbon Program
According to the Pennsylvania Forestry Association’s May 2021 newsletter, 50 Pennsylvania landowners have registered more than 7,000 acres in the Family Forest Carbon Program, which pays landowners to implement carbon sequestration practices in eligible counties on parcels of land between 30 and 2,400 acres and then sells carbon credits to businesses.  The practices consist of growing mature forests, which pays landowners $100 to $300 per acre for restricting timber harvests by developing and complying with two 10-year forest management plans, and enhancing future forests, which pays $50 to $280 per acre for reducing competing vegetation by 85% and maintaining that reduction level.  The central and northwestern Pennsylvania counties currently eligible for the program are Bedford, Blair, Cameron, Centre, Cumberland, Dauphin, Elk, Forest, Franklin, Fulton, Huntingdon, Juniata, McKean, Mifflin, Perry, Potter, Snyder, Tioga, Union, and Warren.  The newsletter states that southwest Pennsylvania will be the next area made eligible for the program.
