Agricultural Law Weekly Review—Week Ending April 8, 2022

Agricultural Antitrust: Lawsuit Claims Dairy Farmers of America and Select Milk Conspired to Suppress Dairy Farmer Payments 🌾
On April 4, 2022, six New Mexico dairy cooperative members filed a complaint in the U.S. District Court for the District of New Mexico against Dairy Farmers of America (DFA) and Select Milk Producers, Inc. (Select), alleging that the defendant dairy cooperatives conspired to depress members’ raw milk price in violation of the Sherman Act (15 U.S.C. § 1). Othart Dairy Farms, LLC v. Dairy Farmers of America, Inc., No. 2:22-cv-00251.  The plaintiffs claim that DFA and Select—who the plaintiffs state control at least 75% of the Southwest dairy market—have used their market share to suppress dairy prices by sharing and coordinating pricing information and decisions and by “selective[ly] . . . nonpooling” milk, which the plaintiffs claim “allow[s] the cooperatives as entities to market members’ milk at higher prices without passing those increases on to farmers.”  The plaintiff dairy producers further claim that the monthly rates DFA and Select pay their respective members “are almost always within a few pennies of each other,” which the plaintiffs state “would not be the case absent the conspiracy alleged herein.”  Defendants have yet to file a response.

Biofuels: EPA Denies RFS Exemption Petitions, Allows Alternative RFS Compliance
On April 7, 2022, the U.S. Environmental Protection Agency (EPA) denied thirty-six small refinery exemption petitions under the Renewable Fuel Standard (RFS) for the 2018 compliance year.  EPA states that it issued the denials in accordance with the Tenth Circuit’s 2020 holding in Renewable Fuels Association v. EPA—that EPA may only grant an exemption if a small refinery demonstrated hardship caused by RFS compliance in 2018 and none of petitions sufficiently made that showing.  EPA allowed thirty-one of the petitioning small refineries to demonstrate their compliance with the 2018 RFS volume obligations by resubmitting their 2018 reports with “zero deficit carryforward and no additional [Renewable Identification Number] retirements.”

Organic Agriculture: USDA Finalizes “Origin of Livestock” Transition Rule.
On April 5, 2022, the U.S. Department of Agriculture’s (USDA) Agricultural Marketing Service (AMS) published a final rule in the Federal Register amending the Origin of Livestock requirements for organic dairy (87 FR 19740). As announced by AMS, the National Organic Program (NOP) final rule creates a one-time exception for transitioning dairy cattle to the otherwise-applicable general rule that dairy cattle must be under continuous organic management from the last third of gestation onward.  The exception allows a one-time option for the transitioning producer to manage cattle organically for a single twelve-month period, after which all exceptions are exhausted for that producer.  All transitioning animals must end their transition period at the same time and an operation may not transition additional nonorganic animals once it has completed the twelve-month organic transition.  The final rule becomes effect June 6, 2022, and certified organic dairy operations must be in compliance with the rule by April 5, 2023.  To further explain the rule, AMS has released a factsheet and will conduct a webinar on April 20, 2022 from 1:00pm–1:30pm ET.

Environmental Policy: Intergovernmental Panel on Climate Change Releases 2022 Report
On April 4, 2022, the Intergovernmental Panel on Climate Change (IPCC) announced the publication of its Working Group III report, Climate Change 2022: Mitigation of Climate Change.  Although the report warns that average annual greenhouse gas emissions from 2010–2019 were at the “highest levels in human history,” it describes scenarios to reduce current emissions by at least 50% by 2030 in all sectors and calls for agriculture and forestry to “provide large-scale emissions reductions” through carbon storage and removal.  However, the report states that these types of carbon reductions cannot offset delayed emissions cutbacks in other areas like infrastructure, transportation, and overall energy consumption.
