 Water Quality: Federal Court Upholds Vacatur of 2020 NRCS Wetlands Final Rule 🌾
On October 8, 2024, the U.S. District Court for the District of Columbia issued an opinion denying the U.S. Department of Agriculture (USDA) Natural Resource Conservation Service’s (NRCS) motion to alter the court’s February 2024 judgment and remand to the agency without vacatur its 2020 wetland conservation rule “to minimize disruption to the agency and the community while NRCS issues a new rule.” National Wildlife Federation v. Lohr, No. 19-cv-2416. The court determined that the agency had “not demonstrated that disruptive consequences must flow from vacatur,” stating, “Although Defendants persuasively argue that being forced to re-certify pre-1996 wetland determinations while a new rule is pending may be burdensome . . . NRCS has temporarily placed a ‘hold on servicing certain new wetland determination requests’ affected by this litigation.” The court further noted that, while the agency “argue[s] that th[e] hold is only in place while NRCS ‘determines how that processing should occur in compliance with the Court’s order,’” it “give[s] no reason why NRCS could not continue that hold for the ‘9–12 months’ it will take to ‘publish a new Interim Final Rule.’” See also ALWR—Mar. 11, 2024, “Water Quality: Federal Court Vacates, Remands 2020 NRCS Wetlands Final Rule.” 

Packers and Stockyards Act: USDA Publishes ‘Price Discovery and Competition in Markets for Fed Cattle’ Proposed Rule
On October 11, 2024, the U.S. Department of Agriculture (USDA) Agricultural Marketing Service (AMS) published in the Federal Register a proposed rule (89 FR 82519) requesting “input from stakeholders about ways to improve price discovery . . . in fed cattle markets, many of which are concentrated markets.” Also announced by USDA, the proposed rule would establish regulations regarding alternative marketing agreements, most of which are “formula pricing agreements that use an external benchmark price to establish a base price” that “is not known when the contract is signed, and . . . fluctuates in accordance with the benchmark.” The proposed rule provides four categories of regulatory changes for covered packers, none of which “would be defined as small businesses by the Small Business Administration because all covered packers to which the [proposed rule] applies have more than 1,150 employees”: (1) general regulatory options, (2) specific base price regulatory options, (3) presumptively permissible base price options, and (4) written documentation options. The proposed rule is available for public comment until December 10, 2024.

Packers and Stockyards Act: USDA Publishes Interim Report on Competition and Fair Practices in Meat Merchandising
On October 8, 2024, the U.S. Department of Agriculture (USDA) Agricultural Marketing Service (AMS) published an interim report on competition and fair practices in meat merchandising, along with an accompanying fact sheet, issued in compliance with Executive Order No. 14036: Promoting Competition in the American Economy. According to the report, “[o]ver the last 40 years, concentration in retail and distribution markets and among meatpackers has dramatically increased, and the number of livestock producers has declined.” AMS notes that “conduct of concern . . . includes practices such as excessive marketing fees, accrual fees arrangements, and potentially anticompetitive preferential arrangements and price discrimination by certain food distributors, meat packers, and retailers.” AMS states that “the report is interim because industry cooperation was only partial” and notes that “USDA is also continuing an investigative study, including enforcing subpoenas where necessary.”

Antitrust: McDonalds Files Complaint Alleging Price-Fixing Conspiracy Against Beef Packers
On October 4, 2024, McDonald’s Corporation filed a complaint in the U.S. District Court for the Eastern District of New York against several beef packers, including Cargill, JBS, National Beef, Swift Beef, and Tyson, alleging that the companies “engaged in a continuing . . . conspiracy in unreasonable restraint of trade to artificially fix, raise, increase, and/or stabilize the wholesale price for beef sold to [McDonald’s] . . . in violation of [the Sherman Act].” McDonald’s Corporation v. Cargill, Inc. et al, No. 24-cv-07017. McDonalds claims that the beef packers “implemented their conspiracy by coordinating, manipulating, or agreeing to pay less than competitive prices for . . . fed cattle . . . for the purpose . . . of fixing . . . or maintaining above competitive levels their margins on . . . beef sold to [McDonalds]” and “by collusively reducing the slaughter-ready cattle and beef supply,” which McDonalds claims “artificially elevated the price of beef.” The complaint demands a jury trial and requests that the court enjoin the defendant beef packers from the alleged activities.

Animal Welfare: Iowa Takes Custody of 1.3 Million Broiler Chickens from Pure Prairie Poultry
On October 2, 2024, the Iowa Department of Agriculture & Land Stewardship announced that the state “was granted an emergency court order . . . to take immediate care, custody and control of approximately 1.3 million broiler chickens owned by Pure Prairie Poultry, Inc,” headquartered in Fairfax, Minnesota. According to the announcement, “on Monday, September 30, Pure Prairie Poultry, Inc. notified the Department that, due to their financial position, they were unable to purchase feed for these chickens located at 14 Iowa farms,” after which “the Department, under its authority in Iowa Code Chapter 717 [‘Injury to Livestock’], sought an emergency court order to take . . . control of the birds.” The Department states that it “will seek reimbursement of the taxpayers’ costs from responsible parties, including through possible legal remedies.”

Water Quality: Ninth Circuit Denies Petition for Review of 2017 CAFO Rulemaking Petition
On October 2, 2024, the U.S. Court of Appeals for the Ninth Circuit filed an unpublished memorandum disposition denying a petition for review of the U.S. Environmental Protection Agency’s (EPA) denial of a 2017 petition to promulgate stricter Clean Water Act (CWA) regulations for concentrated animal feeding operations (CAFOs). Food & Water Watch v. EPA, No. 23-2146. The court noted that, though EPA declined to immediately publish a new rule, the agency “decided that it would do two things: (1) convene a committee of stakeholders to solicit insights into the problem and (2) initiate a study addressing the efficacy of its current regulations.” The court found that “EPA did not act arbitrarily, capriciously, or contrary to law,” stating that, although EPA “declined to open a rulemaking at this moment, it did not refuse to take any action with respect to its CAFO regulations.” The court found that EPA’s justification of “first seek[ing] information about how best to tackle the problem before directing resources toward a new rulemaking” was reasonable under the CWA. Food Safety: USDA Extends Salmonella Proposed Rule Comment Period Until January 17, 2025
On October 11, 2024, the U.S. Department of Agriculture (USDA) Food Safety and Inspection Service (FSIS) Published a Constituent Update stating that the agency had extended the comment period for its August 7, 2024 Salmonella Framework for Raw Poultry Products proposed rule (FSIS-2023-0028). Pesticides: EPA Announces Intent to Issue Proposed Rule, Revoke All But 11 Chlorpyrifos Food Uses
On October 1, 2024, the U.S. Environmental Protection Agency (EPA) announced “additional measures to protect federally threatened or endangered (listed) species and their designated critical habitats from the effects of chlorpyrifos.” According to the announcement, the agency “will soon issue a proposed rule to revoke the tolerances associated with all food uses, except the 11 food and feed crop uses identified in the 2020 Proposed Interim Decision,” which “represent[] about 55% of the total chlorpyrifos usage on agricultural commodities between 2014–2018”: “alfalfa, apple, asparagus, cherry (tart), citrus, cotton, peach, soybean, strawberry, sugar beet, wheat (spring), and wheat (winter).” EPA states that limiting chlorpyrifos to these uses, in addition to “geographic limitations and additional mitigation measures . . . could decrease average annual pounds of chlorpyrifos applied in the U.S. by 70% as compared to historical usage.”

Agricultural Labor: Employer Groups Challenge H-2A ‘Improving Protections for Temporary Ag Workers’ Rule
On October 8, 2024, several agricultural employer groups filed a complaint in the U.S. District Court for the Southern District of Mississippi seeking injunction and vacatur of the Department of Labor’s (DOL) April 2024 rule, “Improving Protections for Workers in Temporary Agricultural Employment in the United States” (89 FR 33898), which grants certain collective bargaining rights to agricultural workers. International Fresh Produce Association v. DOL, No. 1:24-cv-00309. The complaint alleges that the final rule violates the National Labor Relations Act (NLRA) because of the NLRA’s express carveout for agricultural workers and claims that the rule “irreparably harms the State of Mississippi” because it “imposes additional duties and requirements on the [the state’s] compliance reviews,” which will force the [state] to incur additional costs that “are unrecoverable and uncompensated by . . .
