Pesticides/Herbicides: EPA Publishes Final Insecticide Strategy for Federally Listed Species 🌾
On April 29, 2025, the U.S. Environmental Protection Agency (EPA) published its final Insecticide Strategy, which the agency states “represents a framework that EPA will use as it registers and re-registers pesticides” (EPA-HQ-OPP-2024-0299). The final Strategy to Protect Endangered Species from Insecticides details the EPA’s “three-step framework” for agricultural insecticide registration and review actions under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA): (1) “establish[] the potential for population-level impacts to the listed species as not likely, low, medium, or high,” (2) “use[] the potential of population level impacts to invertebrates from Step 1 to identify levels of mitigations needed to reduce spray drift and runoff/erosion to non-target habitats,” and (3) “identif[y] where in the conterminous U.S. the mitigations identified in Step 2 would apply.” Some of the science-based modifications to the Final Strategy include
- “Reducing buffer distances across all application methods;
- Separating spray drift and runoff exposure estimates to identify mitigation specific to each route of exposure . . .
- Providing credit for any reduction in the proportion of a treated field for ground applications;
- Expanding mitigation menu options to allow credit for a reduction in boom length for aerial applications, artificial screens for airblast and ground applications, skipping last downwind row, use of axial deflectors, and targeted application equipment;
- Increasing mitigation points for higher sand soils;
- Developing a process to qualify conservation programs or standards that will give growers credit for the implementation of those programs for runoff and erosion mitigation needs;
- Developing a process to qualify external parties that would assess a grower’s farms and determine the existing mitigation points that could be achieved;
- Adding anionic polyacrylamide (PAM) as a new runoff and erosion mitigation option . . . and
- Adding a Pesticide Use Limitation Area (PULA) group for generalist species that reside in wetlands to reduce mitigations applied outside of wetland habitats.”
EPA states that it “will continue to work with stakeholders and federal partners to ensure effective implementation of the Strategy” and “develop PULA maps that are intended to focus mitigations to where they are needed.” See also ALWR—Aug. 9, 2024, “EPA Publishes Draft Strategy for Conventional Agricultural Insecticides.”
Animal Welfare: Arizona Agriculture Department Publishes Proposed Rule to Delay Cage-Free Egg Requirements
On May 2, 2025, the Arizona Department of Agriculture, Animal Services Division, published in the Arizona Administrative Register a notice of proposed rulemaking to extend the state’s cage-free housing requirements for egg-laying hens until January 1, 2032, previously January 1, 2025 and extended to January 1, 2027. Announced by Arizona Governor Katie Hobbs in March 2025, the cage-free rule and deadline extension applies to commercial producers with more than 20,000 hens and also includes “eggs and egg products purchased outside of Arizona used by a bakery or manufacturer in products produced that are offered for sale to retailers, wholesaler, or consumers for human consumption within th[e] state.” The proposed rule notes the “outbreak of Highly Pathogenic Avian Influenza (HPAI) that began in 2022,” which “contributes to elevated egg prices by reducing egg-layer flocks and egg production” and cites retail egg price increases of “12.5 percent in February 2025, following increases of 13.8 and 8.4 percent in January and December, respectively.” Additionally, the rule refers to the March 2025 update of the U.S. Department of Agriculture (USDA) Economic Research Service (ERS) Food Price Outlook, stating, “Egg prices are predicted to increase 57.6 percent in 2025, with a prediction interval of 31.1 to 91.5 percent.” The department is accepting comments on the proposed rulemaking until June 9, 2025. Dairy Policy: U.S. Dairy Export Council, National Milk Producers Federation Sign MOU with Indonesia
On May 1, 2025, the U.S. Dairy Export Council (USDEC) and the National Milk Producers Federation (NMPF) signed a memorandum of understanding (MOU) with the Indonesian Chamber of Commerce and Industry (KADIN) “to articulate a shared vision and to promote collaboration” for a “sustainable dairy trade to the mutual benefit” of the United States and Indonesia. Also announced by USDEC and NMPF, the non-binding MOU includes several “key areas of collaboration” including “the incorporation of school milk into [Indonesia’s] Free Nutritious Meals program,” “constructive engagement between relevant authorities . . . on regulatory procedures, including the registration of dairy facilities,” the exchange of “relevant data and information on trade trends and market opportunities,” and joint “public communication efforts to promote the benefits of dairy nutrition, especially in the context of child growth and school-based interventions.” The MOU became effective upon signature of the parties and is effective until December 31, 2026.
Biotechnology: Pig Improvement Company Announces FDA Approval for PRRS-Resistant Gene Editing
On April 30, 2025, the Pig Improvement Company (PIC) announced that it had received approval from the U.S. Food and Drug Administration (FDA) for the company’s gene editing technology to produce pigs resistant to Porcine Reproductive and Respiratory Syndrome (PRRS). PIC—a subsidiary of the UK-based animal genetic company Genus with North American headquarters in Hendersonville, Tennessee and Winnipeg, Manitoba—states that it is “among the first companies to gain approval for gene editing in commercial livestock in the U.S.” Also announced by Genus and on PIC’s PRRSResistantPig.com site, PIC states that the FDA approval deemed that PIC’s PRRS-resistant gene editing “technology is safe and effective” “for use in the U.S. food supply chain.”
Specialty Crops: USDA Issues $1.3 Billion in CCC Funds Under Marketing Assistance for Specialty Crops Program
On April 29, 2025, the U.S. Department of Agriculture (USDA) announced a $1.3 billion “second round of payments” under the Marketing Assistance for Specialty Crops (MASC) program, funded with $2.65 billion from the Commodity Credit Corporation (CCC) and authorized in December 2024 and early January 2025 by the previous administration. According to the announcement, applications for the MASC program closed January 10, 2025.
