Agribusiness: Pennsylvania Opens Farm Vitality Planning Grant Program, $500,000 Available 🌾
On May 17, 2025, the Pennsylvania Department of Agriculture (PDA) published in the Pennsylvania Bulletin a notice (55 Pa.B. 3427) of the standards and requirements for the Agricultural Business Development Center’s (ABDC) Farm Vitality Planning Grant Program. According to the notice, the program will provide grants up to $15,000, limited to 75% of project costs, to help recipients with the following activities:
- “Create or obtain business plans and management strategies to enhance the long-term economic viability of a farm.”
- “Create or obtain plans for the transition of ownership and operation of a farm to new owners and operators.”
- “Create or obtain plans for transfer of ownership and operation of a farm within the farmer’s family.”
- “Create or obtain business planning to diversify an existing agricultural operation to new or different forms of agricultural production, including on-farm value-added processing and agritourism.”
- “Maintain the long-term economic viability and protect the investment of public funds in preserving farms that are subject to perpetual agricultural conservation easements acquired under the Agricultural Area Security Law (3 P.S. §§ 901—916), for agricultural production.”
- “Create or obtain business planning for a farm expansion or to seek financing for farm growth.”
PDA states that $500,000 is available and that it “will accept [and review] applications received on or after May 19, 2025 . . . in the order they are received and . . . award grants on a continuous basis until available funds are exhausted.”
International Trade: Federal Circuit Court Holds ‘Fruit’ Includes ‘Mixed Fruits’ in Tariff Classification
On May 9, 2025, the U.S. Court of Appeals for the Federal Circuit issued an opinion affirming the Court of International Trade’s determination that a Canadian company’s frozen fruit mixtures were properly classified under U.S. Harmonized Tariff Schedule subheading 0811.90.80 (“Fruit . . . frozen . . . other”). Nature’s Touch Frozen Foods (West) Inc. v. United States, No. 23-2093. The company argued that, because “the subheadings of heading 0811 all describe individual fruits or groups of specific fruits—not mixtures,” its “frozen fruit mixtures should . . . be classified under subheading 2106.90.98, ‘Food preparations not elsewhere specified or included . . . Other,’” which “are entitled to duty free treatment under the North American Free Trade Agreement.” The court agreed with the trial court that “the common meaning of ‘fruit’ describes mixed fruits” and “does not imply a limitation to individual types of fruit.” The court stated, “We see no error in the trial court’s analysis that ‘fruit’ properly encompasses mixed fruits” and held that the “frozen fruit mixtures are properly classified in heading 0811.”
Agricultural Labor: Federal Court Upholds ‘Temporary Ag Workers Rule,’ Cases Still Pending
On May 5, 2025, the U.S. District Court for the Eastern District of North Carolina issued an order granting summary judgment in favor of the U.S. Department of Labor (DOL) in a case challenging the department’s H-2A final rule, “Improving Protections for Workers in Temporary Agricultural Employment in the United States.” N.C. Farm Bureau Fed’n, Inc. v. U.S. Dep’t Labor, No. 5:24-cv-00527. The court found in favor of DOL on all four arguments raised by the plaintiff producers, holding that the rule (1) “does not raise a major question” under the major questions doctrine, (2) does not exceed DOL’s statutory authority, (3) is not an arbitrary and capricious agency action, and (4) does not conflict with the National Labor Relations Act of 1935 (NLRA). The court departed from the reasoning of the three other district courts that have heard challenges to the rule and issued injunctions prohibiting DOL from enforcing portions of the rule, which notably prohibits employer “retaliation for self-advocacy and concerted activity.” The court stated, “Without addressing the definition of ‘collective bargaining,’ the courts in Kansas and Barton determined the Final Rule conflicts with the NLRA by bestowing upon H-2A workers the right to collectively bargain.” However, the court found that “‘collectively bargain’ is a term of art defined in the NLRA as ‘the performance of the mutual obligation of the employer and the representative of the employees to meet at reasonable times and confer in good faith,’ and ‘the negotiation of an agreement . . . and the execution of a written contract incorporating any agreement reached.” The court then reasoned that “[b]ecause nothing in the Final Rule requires such ‘mutual obligation’ or ‘negotiation,’ it does not convey a right to collectively bargain.” Parts of the rule remain blocked in the other pending cases. Food Labeling: Florida Farm Bill Prohibits ‘Mislabeled’ Plant-Based Products, Unauthorized Drones on Farmland
On May 15, 2025, Florida Governor Ron DeSantis signed into law SB 700 (PDF), known as the “Florida Farm Bill.” Among numerous changes, the law establishes the following provisions:
- “Grants the department rulemaking authority to enforce the Food and Drug Administration’s (FDA) standard of identity for meat, poultry, and poultry products, to prohibit the sale of plant-based products mislabeled as meat, poultry, or poultry products in th[e] state,” effective upon enactment of a mandatory labeling program by Florida’s Department of Agriculture and Consumer Services;
- “Prohibits the use of drones on agricultural lands by unauthorized individuals”;
- “Prohibits local governments from adopting or enforcing any regulation that inhibits the construction of housing for legally verified agricultural workers and provides requirements for such housing”; and
- “Prohibits the use of any additive to a public water supply that is not for the explicit purpose of improving water quality,” namely fluoride.

Biotechnology: Federal Court Allows Dormant Commerce Clause Claim to Proceed Against Florida’s Cultivated Meat Prohibition
On April 25, 2025, the U.S. District Court for the Northern District of Florida issued an order granting the Florida Agriculture Commissioner’s motion to dismiss all counts—except Plaintiff cultivated meat company Upside’s dormant Commerce Clause claim—in a case challenging the legality of the state’s prohibition on the sale and manufacture of cultivated meat (Fla. Stat. §§500.452(1)–(6)). Upside Foods Inc. v. Simpson, No. 4:24-cv-00316. The court “conclude[d] that [Upside] ha[d] plausibly alleged that Florida’s ban violates the dormant Commerce Clause by discriminating in effect against interstate commerce through excluding out-of-state businesses and products from Florida’s market to protect in-state businesses against a projected decline in market share.” Additionally, the court found that Upside’s “allegations of discriminatory effect are also bolstered by its allegations regarding Florida officials’ statements [PDF] about the ban’s protectionist purpose.” The court further stated, “The question remains as to whether conventional meat and cultivated meat are actually in the same market or in competition with one another . . . [b]ut on a motion to dismiss, it is sufficient that Plaintiff has alleged that the two are competing products and that barring cultivated meat from coming into Florida benefits Florida’s in-state conventional meat industry.” The case will now proceed towards discovery and trial. Pesticides/Herbicides: Georgia Law Establishes EPA-Approved Labels Sufficient for State Duty-to-Warn Law
On May 9, 2025, Georgia Governor Brian Kemp signed into law SB 144 (PDF), establishing that “a manufacturer cannot be held liable for failing to warn consumers of health risks above those required by the United States Environmental Protection Agency [EPA] with respect to pesticides.” Under the law, beginning January 1, 2026, a pesticide label approved by the EPA pursuant to the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) displayed on a registered pesticide “shall be deemed a sufficient warning label” regarding a state-law or common-law duty to warn claim. The law does not apply if EPA determines that “a manufacturer knowingly withheld, concealed, misrepresented, or destroyed material information regarding the human health risks of such pesticide in order to obtain or maintain approval of its label by the [EPA].” See also ALWR—Apr. 29, 2025, “North Dakota Law Establishes EPA-Approved Labels Sufficient for State Duty-to-Warn Law,” ALWR—Apr. 15, 2025, “Monsanto Files Petition for Certiorari Seeking FIFRA Preemption in Glyphosate Cases” and CASL’s Glyphosate Issue Tracker.
Pesticides: Federal Court Finds ‘No Injury’ for Pesticide Levels Below EPA-Approved Tolerance for Imported Oats
On March 18, 2025, the U.S. District Court for the Northern District of Illinois issued an opinion granting Quaker Oats Company’s motion to dismiss a class action claim alleging that the company’s “promotion of the whole grains in its Products as healthy is misleading given the presence . . . of chlormequat,” which is prohibited in U.S.-grown oats but allowed in imported oats at an EPA-approved tolerance of 40,000 parts per billion (ppb). Tepper v. The Quaker Oats Company, No. 1:24-cv-02055. The consumer plaintiffs “refer[red] to a peer-reviewed study by the Environmental Working Group [EWG] that showed the presence of chlormequat in . . . the Products, with the highest amount . . . found in Quaker Old Fashioned Oats at 291 ppb.” The court found that the plaintiffs had “not plausibly alleged that the EPA’s regulations establishing safe levels of chlormequat in imported oats do not also apply to oats grown in the United States for the purposes of determining whether the level of chlormequat in a product is safe or unsafe,” noting that “the highest amount of chlormequat that Plaintiffs allege was found in the Products is 291 ppb or .291 ppm—.7% of the EPA’s tolerance level for chlormequat.” The court then determined that “the only reasonable inference is that whether the oats in the Products were imported or grown in the United States, the levels of chlormequat in the Products were safe,” stating, “Plaintiffs’ allegations about the harm that chlormequat poses to humans is hypothetical.” The court held that the plaintiffs did not have standing because they failed to allege an injury-in-fact and dismissed the case with prejudice.
