Agribusiness: FinCEN Announces Pause on BOI Enforcement, Upcoming Interim Rule 🌾
On February 27, 2025, the U.S. Financial Crimes Enforcement Network (FinCEN) announced that the agency “will not issue any fines or penalties or take any other enforcement actions against any companies based on any failure to file or update beneficial ownership information (BOI) reports pursuant to the Corporate Transparency Act by the current deadlines,” which have been extended until March 21, 2025. FinCEN further states, “No fines or penalties will be issued, and no enforcement actions will be taken, until a forthcoming interim final rule becomes effective and the new relevant due dates in the interim final rule have passed.” For more, see National Agricultural Law Center Partner article, Most BOI Reports are Due March 21, but No Penalties for Now, Kristine A. Avian Influenza: USDA Announces $1 Billion Five-Part Strategy for HPAI
On February 26, 2025, the U.S. Department of Agriculture (USDA) announced a $1 billion five-part strategy to address highly pathogenic avian influenza (HPAI), detailed by Agriculture Secretary Brook Rollins in a Wall Street Journal opinion article. According to the announcement and article, the strategy includes
- $500 million for biosecurity measures, including providing “Wildlife Biosecurity Assessments” “at no cost to all commercial egg-laying chicken farms” and “pay[ing] up to 75% of the cost to repair biosecurity vulnerabilities,”
- $400 million for “farmers whose flocks are affected by avian flu,” including continuing payments under the existing indemnity program,
- $100 million for “research and development of vaccines and therapeutics,”
- “remov[ing] . . . regulatory burdens on egg producers,” “includ[ing] examining the best way to” address “overly prescriptive state laws, such as California’s Proposition 12,” and
- “consider[ing] temporary import options.”

Avian Influenza: Elanco, Medgene Establish Agreement to Commercialize HPAI Vaccine for Dairy Cattle
On February 25, 2025, Elanco Animal Health Incorporated announced that it had entered into an agreement with Medgene, a South-Dakota based animal health company, to commercialize a vaccine for highly pathogenic avian influenza (HPAI) for use in dairy cattle. Elanco states that “Medgene reports the vaccine has met all requirements of the U.S. Department of Agriculture’s (USDA) platform technology guidelines and is in the final stages of review for conditional license approval.” According to the announcement, “USDA previously approved Medgene’s vaccine platform technology in cattle” and “Medgene has existing vaccine manufacturing supply ready to deploy.”
Animal Health: USDA Reopens Comment Period for US Swine Health Improvement Plan
On February 28, 2025, the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) published in the Federal Register a proposed rule (90 FR 10876) reopening the comment period for the agency’s US Swine Health Improvement Plan proposed rule (89 FR 107045), previously published December 31, 2024. Food Labeling: FDA Delays Final Rule Updating ‘Healthy’ Food Claim
On February 25, 2025, the U.S. Food and Drug Administration (FDA) published in the Federal Register a rule (90 FR 10592) delaying the effective date of the agency’s ‘Healthy’ food labeling final rule (89 FR 106064), published on December 27, 2025 (FDA-2016-D-2335). According to the rule, FDA is delaying the final rule until April 28, 2025 “in accordance with the memorandum of January 20, 2025, from the President, entitled ‘Regulatory Freeze Pending Review.’” However, FDA states that the February 25, 2028 compliance date “remains unchanged at this time.” See also ALWR—Jan. 7, 2025, “FDA Publishes Final Rule Updating ‘Healthy’ Food Claim.”
Biotechnology: Brown Foods Announces First Lab-Grown Milk
On February 25, 2025, cellular agriculture company Brown Foods issued a press release (PDF) announcing that the company had created “the world’s first test tube of lab-grown milk.” According to the announcement, the company’s UnReal Milk “contains all essential proteins, fats, and carbohydrates that make up 99% of traditional cow milk.” Additionally, the company states that “an independent third-party analysis by the Whitehead Institute for Biomedical Research, affiliated with MIT, confirmed the presence of all key dairy proteins, including Alpha-S1-Casein, Alpha-S2-Casein, Beta Casein, Kappa Casein, Alpha-lactalbumin, Beta-lactoglobulin, Lactotransferrin, and Albumin.” Brown Foods further states that it “is committed to bringing UnReal Milk to consumers for tasting by late 2025 . . . followed by a market pilot in late 2026.”
Agricultural Labor: Fourth Circuit Affirms Denial of Preliminary Injunction Against H-2A ‘Non-Ag Data’ Wage Rule
On February 24, 2025, the U.S. Court of Appeals for the Fourth Circuit issued an opinion affirming the district court’s 2023 order denying a preliminary injunction against the Department of Labor’s (DOL) February 2023 final rule, which amended the H-2A wage rate calculations to include data from non-agricultural occupations. USA Farm Labor v. Micone, No. 23-2108. The Fourth Circuit held that the “district court did not abuse its discretion in denying the preliminary injunction” and that the “district court reasonably concluded that the balance did not tip in favor of an injunction.” See also ALWR—Oct. 9, 2023, “Federal Court Denies Preliminary Injunction of February 2023 H-2A Wage Rule.”
