This Week: Fri. Mar. 28, 2025, Understanding the Basics of the Clean Water Act & Ag: Impaired Waters & TMDL Process

National Agricultural Policy: USDA Announces $10 Billion for Direct ECAP Payments 🌾
On March 18, 2025, the U.S. Department of Agriculture (USDA) announced (PDF) that the agency “is issuing up to $10 billion directly to agricultural producers through the Emergency Commodity Assistance Program (ECAP) for the 2024 crop year” to “help agricultural producers mitigate the impacts of increased input costs . . . falling commodity prices . . . and ‘market uncertainty.’” According to the announcement, the Farm Service Agency (FSA) “will begin sending pre-filled applications to producers who submitted acreage reports to FSA for 2024 eligible ECAP commodities.” ECAP applications are open March 19 through August 15, 2025.

Avian Influenza: USDA Announces HPAI Biosecurity Assessment Programs, Vaccine Funds
On March 19, 2025, the U.S. Department of Agriculture (USDA) announced two biosecurity assessment programs available to commercial poultry producers not affected by Highly Pathogenic Avian Influenza (HPAI)—Wildlife Biosecurity Assessments and Biosecurity Incentives-Focused Assessments. According to the announcement, “APHIS will prioritize assessments at commercial egg-laying facilities in the highest egg-producing states” and, if HPAI risks are identified, “USDA will share up to 75% of the costs to fix the highest risk biosecurity concerns.” Additionally, on March 20, USDA also announced that the agency will spend up to $100 million “to explore prevention, therapeutics, research, and potential vaccine candidates” for HPAI.  

Agricultural Labor: USDA Directs FSIS to Issue Pork, Poultry Line Speed Waivers
On March 17, 2025, the U.S. Department of Agriculture (USDA) announced that the Agriculture Secretary had directed USDA’s Food Safety and Inspection Service (FSIS) to “extend waivers allowing pork and poultry facilities to maintain higher line speeds” and immediately begin a “rulemaking to formalize th[e] speed increases.” Additionally, USDA states that “FSIS will no longer require plants to submit redundant worker safety data, as extensive research has confirmed no direct link between processing speeds and workplace injuries.” See also ALWR—Jan. 21, 2025, “FSIS Publishes Swine, Poultry Processing Line Speed Evaluation Studies.”

Food Safety: FDA to Extend ‘Food Traceability Rule’ Compliance Date Until July 2028
On March 20, 2025, U.S. Food and Drug Administration (FDA) announced “its intention to extend the compliance date for the Food Traceability Rule by 30 months”—from January 20, 2026 to July 2028. The Food Traceability Rule, which became effective in January 2023, establishes recordkeeping requirements for those who “manufacture, process, pack, or hold foods the Agency has designated for inclusion on the Food Traceability List.” FDA states that it “remains committed to successful implementation of the full requirements of the final rule” and, as such, “the compliance date extension does not amend, nor do[es] . . . Animal Welfare: USDA Delays Horse Protection Act Final Rule Until February 2026
On March 21, 2025, the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) published in the Federal Register a rule (90 FR 13273) further delaying the effective date of the agency’s May 2024 Horse Protection Act final rule (89 FR 39194), which transferred authority solely to APHIS-authorized inspectors to detect and diagnose soring at horse shows, exhibitions, sales, and auctions. The current action delays the effective date of the final rule until February 1, 2026, and is available for comment until May 20, 2025. Agricultural Labor: DOL Publishes Notice Increasing Employer Meal Charge for H-2A Workers
On March 24, 2025, the U.S. Department of Labor (DOL) Employment and Training Administration published in the Federal Register a notice (90 FR 13500) updating the allowable monetary charges for H-2A employers. According to the notice, the updated maximum allowable amount that employers may charge H-2A workers for providing them with three meals per day is $16.28, up from $15.88, unless otherwise authorized by the Office of Foreign Labor Certification. Additionally, the notice states that the “maximum daily amount an employer is required to reimburse workers for travel-related subsistence . . . is $68.00 per day for 2025.” See also ALWR—Feb. 20, 2024, “DOL Publishes Notice Updating H-2A Meal Charge and Travel Reimbursement Rates.”

Biotechnology: Mississippi Passes Law Prohibiting Production, Sale of Cultivated Meat
On March 12, 2025, the Mississippi State Legislature enrolled HB 1006 (PDF), which, in accordance with the state’s constitution (Art. 4, Sec. 72), became law without the governor’s approval on March 21, 2025. The bill, which passed unanimously through both chambers, defines “cultivated meat” as “any food product produced from cultured animal cells” and prohibits the “manufacture . . . sale or distribut[ion] [of] any cultivated food product in th[e] state.” Under the law, violators are guilty of a misdemeanor, punishable by a $500 fine or up to three months imprisonment in the county jail. The law becomes effective July 1, 2025. See also the Center’s Cell-Cultured Food Regulations Issue Tracker.

Food Labeling: Utah Passes Cultivated, Plant-Based ‘Meat Substitute’ Labeling Bill
On March 19, 2025, Utah Governor Spencer Cox signed into law HB 138 (PDF), which regulates labeling of “cultivated meat products” and “plant or insect-based meat substitutes.” The law defines both products and specifies that “a food that contains a plant or insect based meat substitute . . . shall bear a term or phrase on a label in a place on the packaging that is reasonably certain to notify a consumer that the food contains a plant or insect based meat substitute.” The law becomes effective May 7, 2025, although it prohibits enforcement of the new labeling requirements before October 31, 2025.
