 National Agricultural Policy: House Ag Committee Publishes Draft Budget Resolution Plan 🌾
On May 12, 2025, the House Committee on Agriculture announced the publication of its draft text to accommodate the federal budget resolution’s reconciliation directives (H. Con. Res. 14). Additionally, the committee published a section-by-section overview of the draft. International Trade: International Trade Administration Imposes Countervailing Duties on 2,4-D Imports from China, India
On May 27, 2025, the U.S. Department of Commerce International Trade Administration (ITA) published in the Federal Register a notice (90 FR 22232), effective upon publication, “issuing countervailing duty orders on 2,4-dichlorophenoxyacetic Acid (2,4-D) from the People’s Republic of China and India.” According to the notice, the subsidy rate on 2,4-D imports from Chinese companies is 26.5%, except for Shandong Rainbow Agrosciences Co., Ltd. (169.63%), and the subsidy rate for Indian companies is 5.88%, except for Meghmani Organics Limited (6.32%) and Atul Limited (5.29%). The notice follows an April 2025 announcement from the U.S. International Trade Commission (USITC) stating that USITC had “determined that a U.S. industry is materially injured by reason of imports of . . . 2,4-D from China and India (No. 701-710). In March 2024, Corteva filed a petition seeking the additional duties and in May 2024, a preliminary investigation found that 2,4-D imports from China and India were sold below market value and subsidized by their respective governments. International Trade: USITC to Investigate Export Competitiveness of the Nonfat Milk Solids Industries in the United States and Other Major Suppliers
On May 23, 2025, the U.S. International Trade Commission (USITC) published in the Federal Register a notice of investigation (90 FR 22113) to “examine the global nonfat milk solids market and the export competitiveness of the nonfat milk solids industries in the United States and other major suppliers.” Also announced by USITC, the notice follows a request for a report made by the U.S. Trade Representative (USTR) on April 23, 2025, under section 332(g) of the Tariff Act of 1930 (19 U.S.C. 1332(g)). According to the announcement, the report will “focus on the 2020-2024 period” and include “to the extent practicable” (1) “An overview of the global market for products containing high levels of nonfat milk solids in their various forms, including such factors as product end uses, consumption, production, and trade,” (2) “Profiles of the industries producing and exporting products containing high levels of nonfat milk solids in the United States, Australia, Canada, select EU member states, New Zealand, and other countries . . . including information about domestic production, consumption, and export trends in these countries,” (3) “A comparison of the competitive strengths and weaknesses of producers and exporters of nonfat milk solids products from the United States and other major exporting countries,” and “An overview of the competitiveness of U.S. nonfat milk solids products relative to exports from the highlighted countries both in the U.S. market and in third-country markets.” USITC states that it “expects to submit its report to USTR by March 23, 2026.”

International Trade: Costa Rica Approves New Dairy Facility Registration Process
On May 23, 2025, the U.S. Department of Agriculture (USDA) Foreign Agricultural Service (FAS) published a report titled Costa Rica Dairy Facility Registration Requirements. According to the report, Costa Rica’s National Animal Health Service (SENASA) signed a resolution, effective May 10, 2025, that “eliminated the questionnaire process for the registration of U.S. dairy plants” and instead “(1) requires a signed letter from . . . AMS to SENASA verifying the plant’s basic details and compliance with U.S. sanitary requirements, (2) requires a technical fact sheet of the products to be exported, and (3) reduces SENASA’s deadline to review and approve plants from 90 to 30 days.” Also announced by USDA, the new “process applies to all U.S. dairy facilities and products seeking export registration to Costa Rica” and “includes ingredients such as whey, casein, butter oil, and sweet cream.” According to the USDA announcement, on May 22, 2025, SENASA “officially approved the first American dairy cooperative for export to Costa Rica, making it the first U.S. dairy facility to be registered under the new . . . approval process.” 

Dairy Policy: USDA Publishes Final Rule Rescinding Dairy Donation Program
On May 29, 2025, the U.S. Department of Agriculture (USDA) Agricultural Marketing Service (AMS) published in the Federal Register a direct final rule (90 FR 22623) removing the implementing regulations for the Dairy Donation Program (88 FR 57861), established as part of a $6 billion USDA pandemic assistance package. According to the final rule, “the Dairy Donation Program is no longer funded by Congress; therefore, AMS has no authority to take further action under the Dairy Donation Program and its implementing regulations are obsolete.” Additionally, the rule states that it will become “effective on July 28, 2025, without further action, unless adverse comments are received on or before June 30, 2025,” in which case, “AMS will publish a document in the Federal Register withdrawing this rule before the effective date.” The final rule is available for public comment until June 30, 2025.

Regulatory Policy: USDA Publishes Final Rule Removing ‘Unlawful, Unnecessary’ Regulations
On May 29, 2025, the U.S. Department of Agriculture (USDA) Farm Service Agency (FSA) published in the Federal Register a final rule (90 FR 22613), effective upon publication, removing the following “unlawful or unnecessary” regulations in accordance with Executive Order 14219 of February 19, 2025, “Ensuring Lawful Governance and Implementing the President’s ‘Department of Government Efficiency’ Deregulatory Initiative”:

Marketing Orders: USDA Rescinds Natural Grass Sod Research and Promotion Order
On May 29, 2025, the U.S. Department of Agriculture (USDA) Agricultural Marketing Service (AMS) published in the Federal Register a proposed rule (90 FR 22671) withdrawing and terminating the agency’s December 2024 proposed rulemaking to establish a grass sod research and promotion program (89 FR 99149). AMS states that, after conducting a referendum of eligible grass sod producers from January 13–February 11, 2025, the agency “determined that the results of the votes showed that a simple majority of producers were not in favor of issuance of an Order.” According to the proposed rule, AMS received 348 valid ballots with 221 votes against the proposed order and 127 votes in favor of the order. AMS also published a direct final rule (90 FR 22625) rescinding the referendum procedures for the sod proposed order because “the referendum failed” so they “are no longer necessary.” See also ALWR—Jan. 7, 2025, “USDA Proposes Referendum for Natural Grass Sod Research and Promotion Order.”

Biotechnology: Nebraska Enacts Law Prohibiting Sale of Cultivated-Food Products
On May 20, 2025, Nebraska Governor Jim Pillen approved LB246 (PDF), which deems cultivated-food products as “adulterated food” under the state’s Pure Food Act and prohibits the manufacture, sale and distribution of such products under the state’s Deceptive Trade Practices Act. Disaster Assistance Programs: USDA Announces $1 Billion for Emergency Livestock Relief Program 2023, 2024 Payments
On May 29, 2025, the U.S. Department of Agriculture (USDA) Farm Service Agency (FSA) published in the Federal Register a final rule (90 FR 22614) “to implement the Emergency Livestock Relief Program (ELRP) 2023 and 2024.” Also announced by USDA, the rule sets forth “the administrative provisions, eligibility requirements, and payment calculation for ELRP 2023 and 2024.” According to the rule, FSA “will calculate payments using data already submitted to FSA by Livestock Forage Disaster Program participants; therefore, producers are not required to file an additional application to receive ELRP 2023 and 2024 payments.” According to the announcement, USDA will provide $1 billion in 2023 and 2024 ELRP payments.
