Technology: Federal Court Allows Deere Antitrust Case to Proceed 🌾
On June 9, 2025, the U.S. District Court for the Northern District of Illinois issued an opinion and order denying Deere & Company’s motion for judgment on the pleadings and allowing the advancement of a case alleging that the company’s repair restrictions violate federal and state antitrust laws. Federal Trade Commission v. Deere & Company, No. 3:25-cv-50017. The court determined that, although “Deere leaves repair services and parts sales to Authorized Dealers,” the company “‘reaps massive profits’ from its parts business, which relies on those Authorized Dealers’ repairs.” The court further reasoned that “because only Deere can create and license the ADVISOR [repair] tool, it entirely controls who (and how many) Dealers may perform restricted repairs and, by extension, how much the Dealers can charge,” concluding, “ Because the Governments . . . assert that Deere can control prices and exclude competition, it adequately alleges that Deere holds market power.” The court additionally noted, “Notice pleading requires fair notice to defendants. It can’t be reasonably argued that Deere is scratching its metaphorical head and muttering, ‘I wonder what the Governments are complaining about?’ If Deere’s position is that it knows what the Governments are complaining about but that those complaints are not legally cognizable, the Court disagrees.” For background, see ALWR—Jan. 21, 2025, “FTC, Illinois and Minnesota File Antitrust Complaint Against Deere for ‘Service ADVISOR’ Limited Distribution.” 

Environmental Policy: Federal Court Holds ‘Swampbuster’ Constitutional
On May 29, 2025, the U.S. District Court for the Northern District of Iowa issued an opinion granting summary judgment in favor of the U.S. Department of Agriculture (USDA) in a case challenging the constitutionality of the Farm Bill’s wetland conservation “Swampbuster” provision, which disqualifies from federal farm benefits anyone who converts certified wetlands. Agricultural Labor: Maine Law Applies State Minimum Wage to Agricultural Workers
On June 10, 2025, Maine Governor Janet Mills signed into law S.P. 273-L.D. 589 (PDF), which, beginning January 1, 2026, applies the state’s $14.65 minimum hourly wage to agricultural workers and provides that, each year, the minimum wage “must be increased by the increase in the cost of living.” Additionally, the requires employers “to keep a true and accurate record of the hours worked by each employee and the wages paid to each employee” and authorizes the state’s Department of Labor “to bring an action for unpaid wages on behalf of an employee for unpaid minimum hourly wages.” The law exempts members of an employer’s family “who reside with and are dependent upon the employer.” While the initial draft of the law phased in overtime payments of 1 ½ times the regular hourly rate, the final law does not provide for overtime pay.

Agribusiness: West Virginia Passes Foreign Land Ownership Law
On April 28, 2025, West Virginia Governor Patrick Morrisey signed into law H.B. 2961 (PDF), effective July 11, 2025, which prohibits certain foreign parties from “acquir[ing] or own[ing] directly or indirectly, any interest in any real estate in th[e] state, including mineral rights.” For more on the law, see New Addition to Foreign Ownership Law Trend: West Virginia Enacts Restriction on Foreign-Controlled Entities, Nat’l Agric. Environmental Policy: Iowa Governor Vetoes Carbon Dioxide, Pipeline Bill
On June 11, 2025, Iowa Governor Kim Reynolds vetoed H.F. 639 (PDF), which would have established regulations for “hazardous liquid pipelines,” including those carrying liquefied carbon dioxide. According to the governor’s veto letter, “the bill would block a major pipeline project that uses only voluntary easements.” The governor noted a current project “in the final stages of connecting to a CO2 pipeline with not a single acre condemned” but stated that the bill’s “new insurance mandates and . . . 25-year limit . . . would effectively kill the project—despite the millions that have already been spent on its development.” However, the governor stated that she would ask the state’s Utilities Commission to implement two provisions of the bill immediately: “requiring all commissioners to be present for live testimony” and “ensuring that at least one commissioner attends every informational meeting,” which the governor stated, “will improve oversight and transparency now, without the need for new legislation.” See also materials and recording from Understanding the Basics of Pennsylvania’s Carbon Sequestration Law.

Biotechnology: FDA Issues ‘No Questions Letter’ For Wildtype’s Cell-Cultured Salmon
On May 28, 2025, the U.S. Food and Drug Administration (FDA) issued a letter to cellular agriculture company Wildtype Inc. stating that the agency “ha[s] no questions at this time regarding Wildtype’s conclusion that foods . . . containing [the company’s] cultured salmon cell material . . . are as safe as comparable foods produced by other methods” “and would not contain substances that adulterate the food.” However, FDA stated, “The use of the term ‘cultured salmon cell material’ in this letter is not our recommendation of that term as an appropriate common or usual name for declaring the substance in accordance with FDA’s labeling requirements” and “note[d] that 21 CFR 102.5(a) outlines general principles that FDA considers when establishing a common or usual name for nonstandardized foods which Wildtype may want to consider.” Additionally, FDA stated that it “considered only whether the levels of nutrients in the harvested cellular material are safe and not their impact on nutritional quality of the food supply” and noted that “it is Wildtype’s continuing responsibility to ensure that foods it markets are safe, wholesome, and in compliance with all applicable legal and regulatory requirements.” FDA advised, “Should new production procedures, cell lines, or substances employed during production be used that could be relevant to the safety of the food, we strongly recommend that Wildtype contact FDA.”

Dairy Policy: USDA Publishes Milk, Yogurt Labeling Claims Study
On June 6, 2025, the U.S. Department of Agriculture (USDA) Economic Research Service (ERS) published a study titled, “The Prevalence of Competing and Complementary Claims on U.S. Food Product Packaging: A Case Study of Claims on Milk and Yogurt.” The study analyzed the frequency of eleven label claims on milk and yogurt products: (1) “Fat claims,” (2) “Sugar and sweetener claims,” (3) “Digestive benefits claims,” (4) “Claims that high levels of attributes promote health,” such as “dairy products being a good source of calcium and protein” or “claims that highlight the addition of omega-3 fatty acids,” (5) “Claims that low levels of attributes promote health,” such as “low or relatively low levels of calories and cholesterol,” (6) “No-hormone claims,” (7) “Natural claims,” which includes “100-percent natural, no artificial ingredients, no added preservatives, no artificial preservatives, and no preservatives,” (8) “USDA Organic,” (9) “Animal welfare claims,” such as “pasture raised, grass fed, and humane certified,” (10) “Non-GMO claims,” and (11) “Kosher.” According to the study, “the five claims that spotlight farm production methods represented 44.3 percent of all claim types . . . identified on milk and 30.4 percent of all claim types . . . identified on yogurt products” while “the most common claims were related to a product’s fat content and if a product was certified kosher.”
