International Trade: Canada Passes Law Prohibiting Import Quota Increases, Tariff Reductions on Dairy, Poultry, Eggs 🌾
On June 26, 2025, King Charles III assented to Canadian Bill C-202 (PDF), which prohibits Canada’s Minister of Foreign Affairs from increasing import quotas or reducing tariffs on dairy products, poultry and eggs. According to a speech from the bill’s sponsor, in passing the law, Canada “seeks to protect . . . [its] supply management system by preventing additional concessions on the import of dairy products, eggs and poultry.” The sponsor noted the “huge surplus of milk in the United States,” stating, “Wisconsin, in particular, has excess milk production, so it wants to have access to the Canadian market to ship this surplus.” The law became effective upon Royal Assent.
Wildlife Habitat: Pennsylvania Repeals Sunday Hunting Prohibition, Amends Hunting Trespass
On July 9, 2025, Pennsylvania Governor Josh Shapiro approved HB 1431 (PDF), now Act 36 of 2025, repealing the prohibition on Sunday hunting and allowing the Pennsylvania Game Commission (PGC) to set hunting seasons that include Sundays. The bill passed with a 142-61 vote in the House and a 34-16 vote in the Senate, which had also considered a companion bill (SB 67). Also announced (PDF) by the governor, the law will require hunters to obtain written permission to hunt on a Sunday and amends a hunting trespass violation to include a person who “enters or remains on any land of another without authorization to do so, when the land is fenced or enclosed in a manner manifestly designed to exclude trespassers” or “when notice against trespass is given by the placement of identifying purple paint marks on trees or posts on the property.” Act 36 becomes effective September 7, 2025, after which “PGC will set new season dates and bag limits.
Wildlife Habitat: Pennsylvania Amends Game and Wildlife Code on Questioning, Agricultural Definitions, Game Commission Composition
On June 30, 2025, Pennsylvania Governor Josh Shapiro approved SB 518 (PDF), now Act 26 of 2025, which removed a Game and Wildlife Code provision that deemed unlawful the refusal to answer questions by a Pennsylvania Game Commission (PGC) representative. Additionally, the law provides that the terms “agricultural commodity” and “normal agricultural operation” are defined by the Pennsylvania Right to Farm Act and instructs the governor to “ensure that at least one member appointed to the commission represents the interest of agricultural commodities that pertain to normal agricultural operations and wildlife.” The law also directs the PGC to “establish a self-reporting system that allows a person assigned to remove deer for crop damage purposes to report each harvest to an officer of the commission via a toll-free telephone number, online application or publicly accessible Internet website.” The law becomes effective August 29, 2025.
National Agricultural Policy: USDA Announces National Farm Security Action Plan, Opens Reporting Portal
On July 8, 2025, the U.S. Department of Agriculture (USDA) announced the agency’s National Farm Security Action Plan, along with an executive summary. In the plan, USDA describes several actions the agency will implement, across seven areas: (1) “Secure and Protect American Farmland,” (2) “Enhance Agricultural Supply Chain Resilience,” (3) “Protect” the “U.S. Nutrition Safety Net . . . from Fraud, Abuse, and Foreign Adversaries,” (4) “Enhance Research Security,” (5) “Evaluate USDA Programs to Ensure America First Policies,” (6) “Safeguard Plant and Animal Health,” and (7) “Protect Critical Infrastructure.” Among the listed actions, USDA has signed a Memorandum of Understanding with the Department of Treasury regarding “Committee on Foreign Investment in the United States (CFIUS) reviews concerning covered foreign transactions that involve farmland, agricultural businesses, agriculture biotechnology, [and] the agriculture industry” and “launched a new online portal for farmers, ranchers, and others to report possible false or failed reporting and compliance” regarding the Agricultural Foreign Investment Disclosure Act (AFIDA).
Regulatory Policy: USDA Publishes Notice Interpreting ‘Federal Public Benefit’ to Include USDA Loans, Grants, Licenses
On July 10, 2025, the U.S. Department of Agriculture (USDA) published in the Federal Register a notice (90 FR 30621) describing the agency’s “interpretation . . . for the term ‘Federal public benefit’” under the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA). The notice first specifies that, under PRWORA, “aliens who are not ‘qualified aliens’ are not eligible for any ‘Federal public benefit,’” defined under the statute as “(A) any grant, contract, loan . . . or commercial license provided by an agency of the United States or by appropriated funds of the United States” and “(B) any . . . food assistance . . . for which payments or assistance are provided to an individual, household, or family eligibility unit by an agency of the United States or by appropriated funds of the United States.” The notice states, “USDA has not previously considered many USDA programs and activities to provide ‘Federal public benefits’; however, after a focused review of these programs, USDA has concluded that many such programs and activities clearly fall within the PRWORA definition of ‘Federal public benefits,’” including many grants and loans through the Commodity Credit Corporation, Farm Service Agency loans, Rural Development, and Natural Resources Conservation Service, and “licenses issued by the Secretary of Agriculture . . . to allow duty-free importation of certain dairy products otherwise subject to tariffs.” The notice states that it “supersedes any prior interpretation in any notice or other document issued by any USDA agency.”
Regulatory Policy: USDA Publishes Rule Removing Race- and Sex-Based ‘Socially Disadvantaged’ Designations
On July 10, 2025, the U.S. Department of Agriculture (USDA) and several USDA agencies published in the Federal Register a final rule (90 FR 30555) stating that the department “has independently determined that it will no longer employ the race- and sex-based ‘socially disadvantaged’ designation to provide increased benefits based on race and sex in” USDA programs. The rule further states that, while “USDA has faced a long history of litigation stemming from allegations of discrimination in the administration of its farm loan and benefit programs . . . over the past several decades, USDA has undertaken substantial efforts to redress past injustices, culminating in comprehensive settlements, institutional reforms, and compensatory frameworks.” USDA states, “These actions collectively support the conclusion that past discrimination has been sufficiently addressed and that further race- and sex-based remedies are no longer necessary or legally justified under current circumstances.” The final rule lists the following amended programs under Code of Federal Regulations Title 7, Agriculture:

Agribusiness: New Indiana Grain Indemnity Law Becomes Effective
On July 1, 2025, Indiana’s SB 461 (PDF) became effective, updating the state’s Grain Indemnity Program language and procedures for obtaining and revoking grain licenses. Updates include changes to the required net worth to retain a license, a new informal meeting protocol, and a requirement that licensees with several facilities to maintain a license covering all the facilities they own. Right to Farm: New Vermont Law Redefines ‘Generally Accepted Agricultural Practices’
On July 1, 2025, Vermont’s Act 61 (S. 45), “An act relating to protection from nuisance suits for agricultural activities,” became effective. According to a legislative summary, the “act provides that no agricultural activity shall be or become a nuisance when . . . conducted in accordance with generally accepted agricultural practices,” defined to include “the State water quality requirements for farms . . . the requirements of Concentrated Animal Feeding Operation permits . . . the requirements of the State’s Rule for Control of Pesticides, and practices . . . consistent with . . . accepted customs and standards followed by similar operators of agricultural activities in the State.” To assert nuisance protection under the law, farmers “must be in good standing” with the state’s agricultural and natural resources agencies. Additionally, the law provides that “a farmer shall not receive nuisance protection if . . . the agricultural activity has a substantial adverse effect on health, safety, or welfare based upon objective, documented medical or scientific evidence that the agricultural activity was the proximate cause of the alleged effect; or a reasonable person would find that the agricultural activity was a proximate cause of a noxious and significant interference with the use and enjoyment of the neighboring property.” Plaintiffs must, “at least once, attempt to resolve the issue through mediation” before bringing a court action under the law.
Pesticides/Herbicides: Pennsylvania Superior Court Upholds $3.5 Million Jury Verdict for Roundup Plaintiff
On June 25, 2025, the Pennsylvania Superior Court issued an opinion affirming a $3.5 million jury verdict awarded in December 2023 in the Philadelphia County Court of Common Pleas in favor of a plaintiff claiming that Monsanto/Bayer’s glyphosate-based Roundup herbicide caused her non-Hodgkin’s lymphoma. Martel v. Nouryon Chemicals LLC, No. 1259 EDA 2024 (Pa. Super case search); No. 210900084 (Philadelphia County docket access). Monsanto “challenge[d] the trial court’s denial of its post-trial motion for [judgment notwithstanding the verdict]” and claimed that “the trial court erred in denying its motion to transfer venue from Philadelphia County to Westmoreland County.” The court found that none of the issues raised by Monsanto on appeal entitled the company to relief.
