Agricultural Labor: Third Circuit Affirms Dismissal of Meatpacking Plant Workers’ Challenge to OSHA Finding of ‘No Imminent Danger’ 🌾
On January 31, 2023, the U.S. Court of Appeals for the Third Circuit issued an opinion affirming the district court’s dismissal of a complaint filed in July 2020—during the initial months of the COVID-19 pandemic—by workers at a Dunmore, Pennsylvania-based meatpacking plant operated by Maid-Rite Specialty Foods, Inc. Jane Doe I v. Eugene Scalia, No. 21-02057; Jane Does I, II, III v. Scalia, No. 3:20-cv-01260 (M.D. Pa.). The workers sought an emergency writ of mandamus to compel the Secretary of Labor and the Occupational Safety and Health Administration (OSHA) to take action to protect them from the “imminent danger” in the plant posed by COVID-19 when forced to work “shoulder-to-shoulder on its production line.” The district court found that, because OSHA’s inspection in response to a workers’ investigation request determined that an “imminent danger” did not exist, the law did not give employees the right to challenge OSHA’s determination. The Third Circuit affirmed the district court’s findings.  

Packers and Stockyards Act: USDA Launches Cattle Contracts Library Pilot Program
On January 31, 2023, the U.S. Department of Agriculture (USDA) Agriculture Marketing Service (AMS) activated its dedicated webpage for the Cattle Contracts Library Pilot Program, pursuant to authority in the Consolidated Appropriations Act of 2022 and according to the final rule published on December 7, 2022 (87 FR 74951), effective January 6, 2023. This pilot program supplements AMS’s existing Swine Contract Library in establishing and maintaining a database of the types and terms of contracts offered by packers to aid in price discovery and provide equal access to market information for all market participants.

Food Safety: The FDA Announces Structural Consolidation of Human Food Programs
On January 31, 2023, the U.S. Food and Drug Administration (FDA) proposed structural changes focused on strengthening and protecting food supply chains while promoting adaptability. The proposal consolidates the Center for Food Safety and Applied Nutrition (CFSAN), Office of Food Policy and Response (OFPR), and certain functions of the Office of Regulatory Affairs (ORA) into a unified Human Foods Program (HFP). A yet-to-be-named Deputy Commissioner for Human Foods will head the policy, strategy, and regulatory program activities of the HFP. The restructuring is in response to changes recommended by reports conducted by the Reagan-Udall Foundation and the FDA, which examine causes and responses to the instant formula shortage this past summer. Additionally, the FDA proposes to establish a Center for Excellence in Nutrition, an Office of Integrated Food Safety System Partnerships, and a Human Foods Advisory Committee within the HFP. The FDA’s Center for Veterinary Medicine (CVM) will operate in close coordination with the HFP while remaining a stand-alone center.

Nutrition Programs: New Proposed Rule for Child Nutrition Programs Contains Added Sugars Standards, Includes Flavored Milks
On February 7, 2023, the U.S. Department of Agriculture (USDA) Food and Nutrition Service (FNS) published a proposed rule in the Federal Register titled Child Nutrition Programs: Revisions to Meal Patterns Consistent With the 2020 Dietary Guidelines for Americans. The public comment period closes on April 10, 2023. Among other things, the proposed rule contains new added sugar standards for the school lunch and breakfast programs. The proposed added sugars standards target limiting added sugars in grain-based desserts, breakfast cereals, yogurts, and flavored milks. Added sugar limits would be both product-specific and based on weekly dietary limits. There are currently no added sugars standards for school meal programs. In the comment solicitation, FNS states that it plans to publish a final rule in time for school districts to plan for the 2024–25 school year.

Pesticides: EPA Seeks Comment on Draft Biological Evaluation for Cyantraniliprole
On January 31, 2023, the U.S. Environmental Protection Agency (EPA) published a document titled Cyantraniliprole: DRAFT Biological Evaluation Effects Determination for Endangered and Threatened Species and Designated Critical Habitats. The document is an attempt to complete (a) long delinquent and litigated compliance with the Endangered Species Act (ESA) for the 2014 cyantraniliprole pesticide registration and (b) obligations under a November 22, 2022, opinion and court order from the U.S. Court of Appeals for the District of Columbia in In re Center for Biological Diversity, No. 21-1270 (2022). EPA is soliciting public comment until April 2, 2023, on the document.
