Agricultural Law Weekly Review—December 20, 2024

Agribusiness: Federal Court Enjoins Corporate Transparency Act Ownership Reporting Requirement, January 1, 2025 Deadline Paused 🌾
On December 3, 2024, the U.S. District Court for the Eastern District of Texas issued a memorandum opinion and order granting a preliminary injunction enjoining the federal government from enforcing the Corporate Transparency Act (CTA) and its Beneficial Ownership Information reporting requirements. Texas Top Cop Shop, Inc. v. Garland, No. 4:24-cv-00478. The court followed the reasoning identified in the March 2024 opinion in National Small Business United v. Yellen and determined that “the CTA is not justified by the Commerce Clause, nor the Necessary and Proper Clause in conjunction with some enumerated power.” On December 5, 2024, the U.S. Government filed a notice of appeal of the court’s decision to the U.S. Court of Appeals for the Fifth Circuit. As a result of the court’s injunction, the CTA’s January 1, 2025 beneficial ownership information reporting deadline is now paused. Agricultural Labor: DOL Publishes Adverse Effect Wage Rates, Effective December 16 & 30, 2024
On December 16, 2024, the U.S. Department of Labor (DOL) Employment and Training Administration (ETA) published in the Federal Register updated Adverse Effect Wage Rates (AEWRs) for H-2A temporary agricultural workers employed in range (89 FR 101630) and non-range (89 FR 101628) occupations. DOL published the following statement on its AEWR webpage: Under “the Farmworker Protection Rule (89 FR 33898) . . . ‘[t]he updated AEWR will be effective as of the date of publication of the notice in the Federal Register. However, due to the District Court’s issuance of a preliminary injunction in the case Kansas, et al. v. U.S. Department of Labor, No. 2:24-cv-00076 (S.D. Ga., Aug. 26, 2024), DOL is prohibited from enforcing the Farmworker Protection Rule in certain states and with respect to certain entities. Therefore, the effective date of the updated AEWR for these states will be December 30, 2024.” The current non-range AEWR for Pennsylvania is $17.96, which is up from $17.20 (88 FR 86677) and became effective upon publication December 16, 2024. Biotechnology: AquaBounty Announces Termination of Bay Fortune Farming Operations
On December 11, 2024, AquaBounty—the only U.S. Food and Drug Administration (FDA)-approved company to produce genetically modified Atlantic salmon—issued a press release announcing that the company will “immediately begin to wind down its Bay Fortune operation, its only remaining operating farm,” located in Prince Edward Island, a Canadian Province. According to the press release, the company expects to “cull[] . . . all remaining fish and . . . reduc[e] . . . substantially all personnel over the course of the next several weeks.” AquaBounty’s CEO stated that the company’s efforts “to raise capital, including the sale of [its] farms and equipment” “have not generated enough cash to maintain [its] operating facilities” and leaves the company with “no alternative but to close down [its] remaining farm operations and reduce [its] staff.” For more, see the Center’s Genetically Modified Salmon Issue Tracker.

Food Labeling: USDA, FDA Seek Public Comment on Food Date Labeling Terms ‘Sell By,’ ‘Use By,’ ‘Best By’
On December 4, 2024, the U.S. Department of Agriculture (USDA) Food Safety and Inspection Service (FSIS) and the Food and Drug Administration (FDA) published in the Federal Register a notice (89 FR 96205) requesting public comment on food date labeling, including “the use of terms such as ‘Sell By,’ ‘Use By’ and ‘Best By’” (FSIS-2024-0021). According to the notice, while “FSIS and FDA encourage the use of the phrase ‘Best if Used By,’ current federal regulations do not prohibit industry from using other date labeling phrases, such as ‘Sell By’ or ‘Use By,’ if they are truthful and not misleading.” Additionally, the notice states that “the number, diversity, and complexity of food products in the marketplace along with significant variability in the environmental, storage, and distribution conditions of food create challenges for standardization of food safety or quality date labels.” Also announced by FDA, the agencies seek information regarding industry practices and preferences for date labeling, research on consumer perception of date labeling, and food loss and waste research. The information request is available for public comment until February 3, 2025.

Food Policy: Dietary Guidelines Advisory Committee’s 2025 Report Published, Available for Comment
On December 11, 2024, the U.S. Health and Human Services Department (HHS), with the U.S. Department of Agriculture (USDA), published in the Federal Register a notice (89 FR 99883) requesting public comments on the Scientific Report of the 2025 Dietary Guidelines Advisory Committee, available at DietaryGuidelines.gov. Also announced by USDA’s Food and Nutrition Service (FNS), the “Scientific Report, alongside public comments and federal agency input, will inform the two departments as they develop the Dietary Guidelines for Americans, 2025-2030,” which FNS “expect[s] to be published in late 2025.” According to the report, “the Committee could not draw a conclusion about the relationship between consumption of milk with different fat content by older children, adolescents, adults, or older adults and these outcomes because of substantial concerns with the body of evidence” and, as such, “decided that evidence is not sufficient to advise changing current Dietary Guidelines recommendations for primary consumption of unsweetened fat-free and low-fat milk across the lifespan.” Additionally, the report states that “[e]vidence indicates that when reducing butter, processed and unprocessed red meat, and dairy, substitution or replacement with a wide range of plant-based food sources . . . is associated with cardiovascular disease risk reduction.” The scientific report is open for public comment until February 10, 2025 (HHS-OASH-2024-0017) and a public meeting is scheduled for January 16, 2025. 

Agribusiness: Federal Court Preliminarily Enjoins Arkansas Foreign Land Ownership Law
On December 9, 2024, the U.S. District Court for the Eastern District of Arkansas issued a redacted order and notice of order preliminarily enjoining the State of Arkansas from enforcing Act 636 of 2023 (SB 383), which prohibits ownership of property in Arkansas by “foreign-party-controlled businesses,” and Act 174 of 2024 (SB79), which prohibits foreign-party controlled businesses from acquiring or holding any interest in a digital asset mining business (data center) within the state. Jones Eagle LLC v. Ward, No. 4:24-cv-00990. The plaintiffs alleged in their complaint that Acts 636 and 174 are discriminatory and unconstitutional because they discriminate “based on race, alienage, and national origin,” violating the Fourteenth Amendment’s equal protection clause, and that the Acts “discriminate against interstate and foreign commerce in violation of the commerce clause.” The preliminary injunction is currently limited to actions against the plaintiff, Jones Eagle, but the court stated that “Jones Eagle is likely to succeed on its field preemption claim under the foreign affairs doctrine with respect to both Acts 636 and 174.” See also the National Agricultural Law Center’s Foreign Ownership of Agricultural Land Resource Library.

Tax Policy: 2023 Federal Disaster Tax Relief Act Signed Into Law
On December 12, 2024, President Joe Biden signed into law H.R.5863 (P.L. No. 118-148), the “Federal Disaster Tax Relief Act of 2023.” The law “excludes from taxpayer gross income, for income tax purposes, any amount received by an individual taxpayer as compensation for expenses or losses incurred due to a qualified wildfire disaster.” Additionally, the law “excludes relief payments for losses resulting from the East Palestine, Ohio train derailment on February 3, 2023.” Also endorsed by the National Cattlemen’s Beef Association (NCBA), the law will exclude from taxable income payments received by “cattle producers . . . due to wildfires.”

Agricultural Finance: USDA Announces Marketing Assistance Program for Specialty Crop Producers
On December 10, 2024, the U.S. Department of Agriculture (USDA) Farm Service Agency (FSA) published in the Federal Register a notice (89 FR 99212) of funding availability for its new Marketing Assistance for Specialty Crops (MASC) program, which will provide financial assistance to such producers to “offset higher marketing costs related to tenderness and perishability . . . specialized handling and transport equipment . . . packaging to prevent damage; moving perishables to market quickly; and higher labor costs.” Also announced by FSA, the program is available to specialty crop producers who have “an average adjusted gross income (AGI) of less than $900,000 for tax years 2021, 2022, and 2023, unless the producer or legal entity’s average adjusted gross farm income is at least 75 percent of their average AGI” and meets certain eligibility requirements. The MASC application deadline is January 8, 2025.
