National Agricultural Policy: Temporary Restraining Order Issued Against Federal Funding Pause After Memo Rescission 🌾
On January 27, 2025, the Office of Management and Budget (OMB) issued memorandum M-25-13 directing “Federal agencies [to] . . . temporarily pause all activities related to obligation or disbursement of all Federal financial assistance . . . including, but not limited to, financial assistance for foreign aid, nongovernmental organizations, DEI, woke gender ideology, and the green new deal.” The next day, on January 28, two separate complaints were filed seeking an injunction against the memorandum: one filed by several interest groups in the U.S. District Court for the District of Columbia and one filed by twenty-two state attorneys general in the U.S. District Court for the District of Rhode Island. National Council of Nonprofits v. OMB, No. 1:25-cv-00239; New York v. Trump, No. 1:25-cv-00039. That same day, on January 28, the D.C. District Court issued an order granting a temporary administrative stay of the memorandum until February 3, 2025, but on January 29, OMB issued memorandum M-25-14 rescinding memorandum M-25-13 and then filed motions in both cases alleging that the plaintiffs’ claims were moot (Dist. D.C.; Dist. R.I.). On February 3, the D.C. District Court issued a memorandum opinion and order granting a temporary restraining order (TRO) against implementation of M-25-13 and ordering OMB to “provide written notice of the [TRO] to all agencies to which . . . M-25-13 was addressed,” including “instruct[ing] those agencies to release any disbursements on open awards that were paused due to . . . M-25-13.” Additionally, the court declined to “convert th[e] proceeding into one for a preliminary injunction (rather than a TRO),” removing the opportunity for OMB to immediately appeal the TRO. According to the order, “Defendants shall file a status report on or before February 7, 2025, apprising the court of the status of its compliance . . . including by providing a copy of the written notice described above.”
Avian Influenza: PDA Confirms HPAI in Lehigh County Commercial Poultry Flock
On January 27, 2025, the Pennsylvania Department of Agriculture (PDA) announced the agency’s confirmation of the “first positive case of Highly Pathogenic Avian Influenza (HPAI) in domestic poultry in Pennsylvania in 2025,” located in a “50,000-bird layer chicken flock on a commercial poultry farm In Lehigh County.” According to the announcement, samples from the farm “have been shipped to a USDA National Veterinary Services Laboratory for confirmation” and PDA “has quarantined the farm and all commercial poultry facilities, restricting the movement of poultry products within a 10-kilometer radius of the infected flock.” PDA states that “no infections in dairy cattle or humans have been detected in Pennsylvania to date” and that the current situation poses “no risk to the general public,” although the agency notes that “HPAI is highly infectious and is generally fatal to domestic birds.” Additionally, the announcement includes a HPAI map illustrating the implemented control and surveillance zones.
Avian Influenza: H5N9 Confirmed in California in Duck Farm
On January 29, 2025, the California Department of Food and Agriculture (CDFA) announced that the agency had confirmed the presence of H5N9—“a different, additional strain of bird flu” than H5N1—in a commercial duck flock in Merced County (also published by UC Davis School of Veterinary Medicine). CDFA states that the “finding is not unexpected or alarming since ducks serve as a reservoir host for influenza A viruses and there is evidence that the H5N9 virus is a North American N9 reassortant of the H5N1 virus that has been seen in wild birds since 2022 with periodic spillover into domestic flocks.” According to the announcement, CDFA reported the finding to the World Organization for Animal Health (WOAH), which also reported the virus confirmation on January 31, 2025.
