The main purpose of ACRE is to protect Pennsylvania’s “normal agricultural operators from unauthorized local regulation.” Under ACRE, the Pennsylvania Office of Attorney General (OAG) is empowered to: 1) review local ordinances to determine conflicts with state law and 2) to bring legal action against local government units for unauthorized local regulations that prohibit or limit normal agricultural operations.
This guide is intended to present a collection of legal resources relating to the ACRE/Pennsylvania Act 38. While the Center for Agricultural and Shale Law makes every effort to maintain and update the content furnished in this guide, no warranty or other guarantee is made regarding the timeliness or accuracy of any information provided.
