SUMMARY:"Timber Trespass Statutes\," Ross Pifer presents with National Agricultural Law Center
DESCRIPTION:On Wednesday\, June 17\, 2026\, from 12 noon–1:00 ET\, Center Director Ross Pifer will present “Timber Trespass Statutes” as part of the National Agricultural Law Center’s webinar series.  \nMany rural landowners across the country have significant value in standing timber on their lands. Because these forested lands are often remote and boundaries are often not clearly delineated\, many landowners are at risk of having their timber harvested unlawfully and of not being fully compensated for the resulting harm. To address this issue and provide appropriate protection for landowners\, states across the country have enacted timber trespass statutes that provide remedies\, including enhanced damages\, as a deterrent to this unlawful timber harvesting. \nIn this webinar\, we will provide a background of timber trespass statutes generally at the state level. We will review selected provisions in individual state laws with a specific focus on the actions that are subject to these laws and the measure of damages that can be awarded pursuant to them. We will review the difference in how these statutes treat actions by timber harvesters that are considered to be innocent as opposed to those actions that are considered to be willful. We will also discuss issues presented by the application of these statutes related to valuation\, boundary disputes\, and other related topics. \nRegister with the National Agricultural Law Center\n

According to recent USDA data\, “the number of H-2A positions requested and approved has increased more than sevenfold in the past 19 years\, from just over 48\,000 positions certified in fiscal year 2005 to around 385\,000 in FY 2024\,” up from 370\,000 in FY 2022. This webinar will provide an overview of the major provisions of the H-2A program—including a discussion of the adverse effect wage rate (AEWR) and its calculation and application to U.S. employees—and describe the requirements\, processes\, and legal issues related to obtaining and employing H-2A employees.  \n
